5. Correspondence and Announcements
Commissioner Lee
stated presented a plaque to Gregory T. Hafen II for his 7 years of service on the planning commission, only resigning to fulfill his duties as Assemblyman.
8. For Possible Action – ZC-2019-000040: Public Hearing, discussion and deliberation on a request
Ms. Beeman
stated she received a letter of concern, not a letter of opposition, the claimant requested it be read into the record. “I appreciate speaking to you today about the notice I received in the mail concerning this matter. It is my understanding that a meeting will occur on Sept 11, 2019 at 6PM to discuss the rezoning. I am unable to attend the meeting because of a prior commitment. I own a home and 4.4 acres at 4901 E Kellogg Rd, directly across the street. I have owned and maintained this property for my own use for over 7 years, having purchased it in early 2012. I am particularly interested in what development takes place on the Artesia Commercial property because I would be viewing it outside of my kitchen window. I have a beautifully maintained home and property (for E Kellogg Rd!!) and take pride in ownership. In addition to those who live in Artesia that own properties that back up to the property, we are concerned about what type of development is allowed to take place on this parcel. I will continue to follow developments regarding future development at this location. I feel that I would be the most affected due to the fact that I am directly across the street.” Tim Hafen, property owner and applicant stated there are two parcels down there and this is concerning one of them. At the intersection of Fox and Kellogg where it has been represented as a neighborhood commercial to go with the rest of Artesia. We are beginning to see interest in putting some small commercial. What we would like to happen is businesses that will be truly beneficial to that neighborhood will be put in. He recommends the RPC approves this because it was always portrayed this way and situated ideally for that purpose. Gregory Hafen II stated he wanted to address a couple of the concerns as well as the letter of justification that was submitted for this parcel. The history on this parcel, was originally planned back in 2003 and in all the sales documentation we always represented that this was intended to be commercial. In 2007, the planning commission went through a comprehensive rezoning and designated the whole commercial area as neighborhood commercial. It is their intent, to develop this property as the walking path. They want the flexibility to not have that parcel in their way and to do so whether they do a boundary line adjustment, merger or a resub. It was determined through meeting with planning staff that they would need a zone change so both properties have the same zoning. In regard to the concern of the water quality they want to point out that this will be serviced through a public facility, Pahrump Utility Company; water, sewer and Valley Electric for power.
Commissioner Turner
motioned to recommend approval of ZC-2019-000040 for a conforming zone change from VR-20 to NC to allow the processing of the final subdivision map. Commissioner Tyler Seconded.
9. Status Update – CU-2019-000038 Pets are Worth Saving. (QM)
Ms. Wosk
stated today they are maintaining a small rescue, pulling dogs that animal shelters do not feel can be adopted. They take them in, rehabilitate them and find them homes. Since they began in 2015, they have taken in 876 animals and adopted out the same. Since the kennel license has been established, they have taken in 367 and adopted out 356 in the last 2 ½ years. This year they have taken in 33 puppies, which have been adopted out, going out spayed/neutered. All vetted and all their parents have been spayed/neuter through their programs. They have upgraded with a brick wall going around the facility and replaced the roof. Added outdoor kennels for larger dogs from what was before, mainly indoor.
Commissioner Lee
asked staff if they have been able to comply with all of the conditions of approval.
Commissioner Curtis
asked if they take outside animals for boarding.
Ms. Wosk
replied most of their boarding is for low-income, medical reasons and hardships.
Mr. Moore
stated usually people in the hospital. They also take in any dogs that have been adopted through our program. During their hospital stays. Recently they had a dog adopted whose owner had to undergo chest surgery and the dog will come stay with them during their owner’s hospital stay. This allowed the owner to feel more comfortable adopting because he would have been worried about who was going to take care of the dog while he was gone.
Commissioner Turner
stated that he wanted to thank you for what you do to save these dogs.
Mr. Moore
replied that he wanted to let the commissioners know that they have a weekly video that they put up on YouTube on the channel Pets are Worth Saving, so you can see the status of the shelter and what our animals are doing and how they are. Because of the kennels being on private property and closed to the public we want to be able to show them some transparency.
10. For Possible Action: Discussion, deliberation and possible action regarding updating the PRPD

referenced page 99, and suggested corrections be made regarding Petrack Parks development date to 30 years ago. Also, an update to list of renovations to remove: field lighting improvements. The same concept to Simkins park the field lighting and the basketball courts are in and should be added into the major improvement list. Page 4 of 11
Commissioner Duryea
stated on page 100, The Calvada Eye, the section where it states, the cooperative extension is considering holding a weekly Farmer’s Market should be removed as it has been moved to Tractor Supply. Page 101, it was stated that he believes there are only 2 golf courses here in Pahrump. And that under day trips that Death Valley National Monument needs to be changed to Death Valley National Park.
Commissioner Koenig
suggested in the line regarding the motorsports park and the performance driving school, we note that it is the largest in the United States and will shortly be the largest in the world.
Commissioner Duryea
stated in the paragraph starting with the Red Rock National Recreation Area; China Ranch; the historic Amargosa Opera House, Rhyolite, Goldwell Outdoor Air Museum and Tecopa Hot Springs, Big Dunes and Dumont Dunes, he suggested to remove the “and” before Tecopa.
Commissioner Lee
added the suggestion that in the same sentence at the end where it stated, located with and easy day-drive, that it instead say within an easy day-drive.
Commissioner Duryea
referenced page 102, a short paragraph about the fairgrounds is that still our plan.
Commissioner Koenig
stated you may want to add; OHV tracks and convention center. More things will be added in the future as there is a lot of space. Those are all in the plans that we are getting very close to, there are weekly meetings regarding the fairgrounds, and it is finally moving forward.
Mr. Waggoner
stated he would add equestrian trails to the paragraph. And asked Commissioner Koenig if there is a conceptual drawing of the fairgrounds that we could add to this portion of the Master Plan.
Commissioner Koenig
stated yes, as long as we note it as conceptual. It is a live document and is constantly changing and moving things to make other things fit. For example, the OHV tracks will be hooked up to cross over 160 and go up the mountains into the tracks they have and the ones that they are working on with Clark county so you can get from anywhere to anywhere on your four- wheeler.
Commissioner Lee
stated in the paragraph regarding the OHV trail system, it mentions designating routes, and asked if this a continual work in progress to constantly designate routes and identify them.
Commissioner Koenig
replied that is being worked out with the state and Clark County.
Commissioner Lee
asked if the Last Chance park is still a viable project and is it something we want to still keep in the Master Plan.

stated yes, let’s keep it.
Commissioner Duryea
stated page 104 the map still shows the proposed airport that should be removed also where it has the Willow Springs golf course/Discovery Park he can’t tell what color green that is. If it says a golf course, we need to change it to a proposed park or an open space.
Commissioner Koenig
stated if you look towards the top of the map where you see Simkins, before 160 is Simkins Park and you go up 160 and there is a gravel pit and it is marked proposed park.
Commissioner Curtis
asked for clarification on the progress of Discovery Park.

stated its owned by the water company and all progress is up to them. Page 5 of 11
Commissioner Lee
stated they have made improvements such as; updated walking trails, the stream is open and flowing, they have informational boards with local birds and a pollinating rest stop, a fenced area that has flower and plants for bees and butterflies.
Commissioner Curtis
stated I believe there is quite the support from the Audubon society but as far as building or having any other outside entities come in is there any.
Commissioner Koenig
stated as far as he knows, the offer is out there but no one has taken them up on it.
Commissioner Turner
asked if on the original approval were there any stipulations on what they could do with the land when they came in for approval.
Commissioner Koenig
replied that they didn’t come in asking for any approval.
Commissioner Turner
asked if the zoning had to change for the golf course to turn into a park.
Mr. Waggoner
stated that its zoned for open space and a park is a permissive use.
Commissioner Turner
asked for clarification on whether they had to come before this board for an approval on anything pertaining to this park.
Commissioner Lee
stated no, that they have the correct zoning for a park and the only reason they might bring anything to this board is if they did a parcel map adjustment.
Commissioner Turner
asked for clarification if there is anything in our ordinances that might allow us to put a little pressure on them since it is designated a park.
Commissioner Turner
asked if the park is up to code.
Mr. Waggoner
replied, that there are several people that own open space land, including the county, we cannot force people to develop land.
Commissioner Turner
clarified they classified it as Discovery park.
Mr. Waggoner
agreed that they have designated it a park.
Commissioner Turner
asked if they are up to code on weeds and maintenance.
Mr. Waggoner
stated it is vacant land and is in the same condition as much of the vacant land around Pahrump.
Commissioner Turner
stated it’s no longer vacant land, it is a park.
Commissioner Koenig
stated there is nothing we can do.
Commissioner Lee
reaffirmed that we cannot force someone to develop a park stating that if they called it a golf course, we could still not force them to develop it. For example, the town owns land off of Kellogg and it’s called Kellogg park. It isn’t developed but they are making small steps towards development.

in the county we have to bring it up to certain codes once we start building. Page 6 of 11

clarified that is depending on what you are developing and then that’s at a staff level review.
Commissioner Turner
referenced page 100, are the finances under library updated from the state and the government and if not, can we update them.
Commissioner Lee
stated moving onto the maps, on the second map the 2014 PRPD Master Plan Update, with the developed parcels, the statistics need to be updated.
Commissioner Duryea
stated all the maps have the 2014 date.
Commissioner Lee
referenced the BLM disposal status map are there any updates needed.
Commissioner Duryea
stated the proposed airport is still on there.
Ms. Beeman
stated the airport does need to be taken out and more updates will be done after she gets some answers to questions she has. Specifically, she is not sure about the proposed land fill.
Commissioner Turner
stated that an updated one would show the racetrack.
Commissioner Koenig
clarified to Ms. Beeman that the proposed land fill is still there but won’t need to be done for some time.
Commissioner Lee
stated on any of the proposed projects if you haven’t received a definitive no that they be left as proposed projects.
Commissioner Lee
referenced the future land use map, one of our points to talk about is the area in the southeast that expired, do we have any other special plans of development that are close to expiring that haven’t developed that maybe staff could look at.
Ms. Beeman
stated yes, they will look at all the Master Plan areas.
Commissioner Lee
stated if there are any that you know of that had this special plan of development that I’m sure we are getting close to 10- or 15-year expirations. If there are any coming up that we need to look at.
Commissioner Lee
referenced the area in the southeast that is close to the beltway and right below the propose college site. This is the area that was a part of the expired special plan of development. There are hard zones and it has no master plan on it now.
Commissioner Duryea
asked if staff had any suggestions on what should be done.
Ms. Beeman
stated that there are no formulated plans at this time.
Commissioner Lee
asked for a review of the current zoning for these properties; MU, NC, GC.
Ms. Beeman
stated there are some VR-20 and LI in the area as well.
Commissioner Lee
stated it sounds like all of what we have hard zoned and everything that would fit in a gateway project would fit in those zoning districts. She asked if we wanted to change that area to a community development area master plan or not to touch it.
Mr. Waggoner
stated that is what his suggestion would be but is open to ideas.
Commissioner Koenig
asked if any of it is still in the courts. Page 7 of 11
Mr. Waggoner
stated he’s not sure if a lot of them are and several of them are still a part of LLC’s and are still specific to each parcel but may have been split up within partners. Some of it has been through the transfer process.
Commissioner Koenig
stated we should be a bit carful with this if it is still in the courts.
Commissioner Lee
stated she agrees that if there is any pending litigation we should wait until that is resolved but if we could still recommend CDA until that time.
Ms. Beeman
stated this might be a good time to focus on area plans, those special neighborhoods that we know have certain problems, so we aren’t looking at the whole 400 sq. mile valley. We are looking at neighborhoods and the kind of goals and objectives that we are wanting to get that gateway feeling. We know that there are neighborhoods in this valley that we took this broad brush over with and now need to fine tune. So, we may end up with our master plan and some area plans.
Commissioner Lee
stated that is something we need to look at.
Ms. Beeman
stated she hopes by next month staff can come up with a timeline for us to look at and know what we might expect along the way.
Commissioner Lee
asked if we need to change because of the special plan of development master planning expiring. To start a gateway project or to start a neighborhood review in that area do we need to designate it something now or do we want to come back next month with a timeline.
Ms. Beeman
stated we need the timeline, it will give us our roadmap and provide us with some directions. We will need to have some public and neighborhood meetings, social media and other ways to involve our community. We will need help from the community to identify neighborhoods that can be focused on.
Commissioner Tyler
stated the part we are looking at where their plan expired, there is nothing currently developing out there, and no one is coming forward with permits and there are no utilities at the moment.
Ms. Beeman
stated that is correct. Legal, physical access and no utilities makes development difficult.
Commissioner Tyler
added that there are no roads out there.
Commissioner Turner
stated he has heard that there is 122-acre parcel that is being looked at to purchase for residential development. At that point the roads would be put in, if something is not done ahead of time for guidance, they’re zoned as is.
Commissioner Tyler
stated that we have some time to put a recommendation together.
Commissioner Turner
agreed that putting a timeline will be helpful with this process.
Commissioner Blackstock
stated that he looked at the beltway on the map and stated a lot of places don’t like that because they don’t go through the town.
Commissioner Koenig
stated that was what it was designed to do it was for trucks to go around. The original concept was for when Yucca Mountain was a big deal that all the trucks coming through town carrying radioactive material would have to go around our town. Now it would be nice to have for trucks to not have to come through town and when there are accidents on 160 you could still get around it. The cost of it is high, we don’t own the land we would have to acquire it and build the road. Page 8 of 11
Commissioner Blackstock
stated a lot of time when they split cities with a bypass, it’s great for trucks and commuting but people get used to it and the center of town starts to dry up. They avoid the traffic and the 35 mile an hour zone on 160. Diverting the traffic could kill the small business in Pahrump.
Commissioner Koenig
agreed and stated that the larger companies will just move their location closer to the beltway. And stated that it will be an interesting conversation that he is sure will be had, but not in his or Commissioner Blackstock’s lifetime.
Mr. Waggoner
added that this is a part of the Capital Improvement Plan and the reason it is reflected on this map. That is where it might be eliminated from and where the discussion would take place.
Commissioner Lee
stated that the flood control master plan map is where any flood control or drainage basins would be updated per Commissioners Turners previous concerns.
Commissioner Lee
stated the FEMA flood designations need to be updated to reflect the current maps. Commission Lee asked staff for clarification if there are any updates on the soil suitability for building map.
Commissioner Lee
stated the recreation facilities and trails map still has the airport on it.
Commissioner Turner
stated that he recommends different colors on the map for golf course and OPR.
Commissioner Lee
asked Commissioner Koenig when an updated Master Plan needed to be turned in to the BOCC to be adopted.
Commissioner Koenig
stated preferably before the end of the year but doesn’t want it rushed.
Ms. Beeman
stated we now have someone on board to help us with the mapping.
Commissioner Lee
stated that for the October meeting we’ll see the land use.
Ms. Beeman
clarified for the Gateway project that had lost its master planning with the expiration of the master plan of development.
Commissioner Lee
asked if staff could come up with a timeline and a couple of options to move forward.
Commissioner Lee
asked what works best for staff for a timeline to make the corrections.
Mr. Waggoner
stated there is going to be quite a bit of work that goes into chapter 4 and chapter 6. That should be the breaking point because that one is going to take us some time. There is going to be a lot of data that is researched, and input considered. I would take 1-3 and then we can pick up from there when we are ready with some more.
Commissioner Koenig
asked if there is anything that says the BOCC can’t get them piecemeal.

stated they are individual chapters. Page 9 of 11
Commissioner Koenig
clarified if we can separate it there will be more questions and more intelligent answers on individual chapters, as the BOCC will have time to look over each chapter instead of having it in a lump sum and only a few days to evaluate. That allows us to keep moving forward and for you to take your time with the more data intensive material. If I get 1,2 & 3 and then I get 5 and I’m missing 4 and if 4 doesn’t affect 5, 6 or 7, it doesn’t matter. If it does affect it, I don’t want to see it until I have the corresponding part. But it’s up to you whether you want to do that or give it to me in a lump sum.

stated he agrees that it is a good idea to split it up to present it to the BOCC.
Commissioner Lee
asked staff if they could look over everything and figure out a timeline on when they might be able to present to the BOCC and let the RPC know at the October meeting.
11. Future Meetings/Workshops: Discussion and Direction Concerning Items for Future

stated that open meeting law training is currently being discussed for the near future.
Commissioner Koenig
stated that it is presently in the works for new and existing people that need to be trained and refreshed.
Commissioner Lee
stated to the RPC there is open meeting law and ethics training materials in commissioner’s big white binder, make sure you familiarize yourself with that.
12. Public Comment (second) – No action will be taken on matters raised under public comment until

stated that Ms. Beeman has an update on the FEMA map. And since we have been refocusing on Dust Control and compliance, he has been working with NDEP and UNR that team up and we are going to be holding a presentation for the public on dust control and one for the industry tentatively on September 30th.
Ms. Beeman
stated several years ago it started in 2014 we got new FEMA map panels. Particularly along the south eastern part of the community. FEMA is coming back around to finalizing these maps we will have to present them to the BOCC for possible adoption. And public meetings will be held, some people will be mapped out of flood hazards and some people will be mapped into a flood hazard. We will be compiling all that data report on how many people will be affected. Our deadline to have these new FEMA maps adopted is March 6, 2020.

asked is there a public workshop put on to let everyone know of these possible changes, how will people be notified.
Ms. Beeman
stated they will be notifying people, the paper, social media and giving information to the realtors. According FEMA for us to maintain our status in the NFIP these maps must be adopted by March 6, 2020.
