BOCC Liaison Report None b. _Director’s Report Brett Waggoner stated September applications received were 63 in total, processed 121 applications. Since July, 422 new applications received, 89 new code compliance cases. There were 524 applications in September of 2020 and 107 code compliance cases last year in September of 2020. 41 SFR building permits as the previous months were 18. 5 manufactured homes, same as the previous months. Total applications were 300, 99 more than last months. 437 inspections done, which was 13 less than last months, Code compliance had 27 new complaints and 40 closed. For Possible Action — ETSU-21-79: Public Hearing, discussion, and deliberation on an application for an Extension of Time of a Conditional Use Permit (CU-2019-000060) and Waiver (WV-2019- 000086) to allow a Fireworks Retail/Wholesale and Storage Facility (Area 51 Fireworks) on three (3) contiguous parcels zoned General Commercial (GC), located at 1381, 1361 and 1341 E. Nevada Highway 372. Assessor’s Parcel Numbers 038-291-05, 038-291-04 and 038-291-03. D & T Partners, LLC; McKoy, Timothy and Frank, Jr.; and F & T, LLC and Castelblanco, Luis — Property Owners. D & T Partners, LLC - Applicant. Brian R. Hardy, Esq. — Agent. (This item is Final Action by the Pahrump Regional Planning Commission unless appealed to the Board of County Commissioners, or as otherwise announced.) (SO) Steve Osborne reviewed his staff report, the applicant has submitted a SD and comments were sent back to the applicant June |*. Staff suggests a 6-month extension to obtain approval of SD and permits for construction and 2 years for construction of the warehouse. Page 2 of 9 Brian Hardy representing the applicant hopes to get the 6-month extension recommended by staff for approval as well as the 2 years for construction of the warehouse. This has been approved in the past and they are looking for that same treatment.

Commissioner Curtis

asked for clarification on the 6-month approval of the SD. 6 months from what date?

Mr. Waggoner

stated it would be from today if that is what you approve, the 6-month extension was provided to another applicant in town, he would not support anything beyond that.

Mr. Hardy

asked for clarification on the extension date. The extension would start from today’s date or after the one they have now expires, which is in a couple months. With Red Apple it started after the prior one they had, expired.

Mr. Waggoner

stated yes that would be right. It would start after the original expiration date.

Mr. Hardy

stated Yes, that is what we are looking for, the extension to be an additional 6 months from the original one not from today’s date.

Commissioner Lee

asked Mr. Hardy if they have read, understood and agree to the conditions of approval.

Mr. Osborne

reviewed his staff report stating they have the same recommendation as the previous item.

Commissioner Carbone

wanted to clarify when the extension was going to start.

Commissioner Lee

stated it will start when the expiration date of the first approval ends, then an additional 6 months will start.

stated on Page 9. Special condition of approval #9 date is cut off. Page 3 of 9

Mr. Osborne

stated the date is 10/13/2023 for completed construction.

Commissioner Lee

asked Mr. Hardy if they have read, understood and agree to the conditions of approval.

Commissioner Lee

asked for clarification that since the master plan amendment and zone change will go on the BOCC, is the CUP approval conditioned on that?

Ms. Beeman

stated yes it should be.

Commissioner Lee

stated a condition of approval should be added to clarify that. Tyler Mulvey states Public Works comments were not in the back up or as a condition of approval, but they are requesting that the applicant enter into a Road Use and Damage Remediation Agreement with Nye County for identified and approved access routes, and Public Works requests a dedication of 40’ Right-of-Way for the western half of S. Eberhard Rd. along the entire length of APN 047-021-23. Page 4 of 9 10. Russ Meads, stated don’t have much to add. They pretty much explained everything on what we want to do.

Commissioner Lee

asked Mr. Meads if he has read, understood and agrees to the conditions of approval.

Mr. Meads

stated yes. Public comment opened and closed at 6:26 pm with no comments.

Commissioner Turner

amended his first motion to remove the PW conditions and add them to the CUP approval. And amended motion on the CUP that the CUP is contingent upon the approval of the Zone Change and Masterplan Amendment by the BOCC.

Commissioner Tyler

amended her seconds. Motion passed unanimously. For Possible Action —- WV-21-149: Public Hearing, discussion, and deliberation on an application for a Waiver from Nye County Code Title 17, Comprehensive Land Use Planning and Zoning, Section 17.04.245, Village Residential (VR-10) Building Setbacks, to allow for a reduction of the front and rear building setback requirements for single-family residences, for the Celebrate Homes at Mesquite and Blagg subdivision, Phase I, containing 114 residential lots, located at the northeast corner of Blagg Road and Adkisson Street. Time to Celebrate, LLC — Property Owner. D.R. Horton - Applicant. John P, Meng, P.E., President/CEO, Strive Engineering. (This item is Final Action by the Pahrump Regional Planning Commission unless appealed to the Board of County Commissioners, or as otherwise announced.) (SO)

Mr. Osborne

reviewed his staff report to reduce the setbacks for the front or the rear. No homes have been constructed in the subdivision yet. There are utilities and electric on the lots. In a VR-10, the setbacks are 20 ft from the front and 25 ft from the garage to property line and 20 ft setback in the rear, the applicant is asking for 15 ft set back to the house and 20 ft set back from the garage and allow a 15 ft rear setback. Mountain falls allows a 15 ft setback for the front and 20 ft setback to the garage, and they allow a patio cover to encroach one half to the rear, for comparison.

Commissioner Meredith

asks if there will be any issues with the drainage coming off Blagg?

Mr. Mulvey

stated there are known issues, but they are working on that and working with Russ Meads on encroachment permits as well.

Commissioner Turner

asked for clarification that when staff reported there are utilities ran, that means water, sewer and electric?

Mr. Waggoner

stated he believes all the utilities are installed within the subdivision to the 114 lots. Steve Dush, on behalf of DR Horton stated the variance will allow them to construct 3 floor plans all single story with either a bigger front yard or back yard. There will also be 2-3 car garages. The 20 ft driveway will accommodate most vehicles. Page § of 9 11.

Mr. Waggoner

asked what the square footage is of the floor plans?

Mr. Dush

stated 1500-1800 sq ft homes.

Commissioner Meredith

asked what the price range will be for the homes?

Mr. Dush

stated whatever people offer, about low 300’s to high 200’s. Public comment opened at 6:38 pm. John Koenig asks for clarification for the bigger yard. The 20 ft front versus the 25ft front seems to be a smaller yard and not a bigger one.

Mr. Dush

explained they will use either the front or rear waiver request. They will not use both, but only one.

Commissioner Turner

asked for clarification that they will use only a front set back or rear set back determining where it’s at?

Mr. Dush

explained they applied for 2 waivers and if they get approved for the front waiver, they will not need to use the rear waiver.

Commissioner Turner

asked for clarification that depending on where it’s located in the subdivision, if they were approved for both waivers, will they be utilizing both or just one of them on each lot?

Mr. Dush

stated that’s correct. They will not request a variance on both setbacks.

Commissioner Lee

asked for clarification on condition of approval #3 the Parcel map is it a Merger resub parcel map to combine it. Page 6 of 9 12. 13.

Mr. Wollberg

stated they would like clarification on that as well.

Mrs. Medici

stated it would be a Merger-Resub Parcel map. Brent Potts Civil Engineer stated they submitted a tentative map for the project are they are looking to do a commercial subdivision map instead of the parcel map.

Mrs. Medici

stated they can change that to a Commercial Subdivision map. Public comment opened and closed at 6:47 pm with no comments.

Commissioner Lee

asked the applicant if they have read, understood, and agree to the conditions of approval.

Mr. Wollberg

stated yes. with the exception of the amended condition.

Mr. Osborne

reviewed his staff report and stated staff is recommending approval 2 of the street names provided.

Commissioner Lee

states #5 & #6 independently have no issues but whatever they approve she doesn’t believe it would be good to have Ridge Gate Court and Ranch Gate Place in the subdivision as street names it might be confusing, so if they can pick one or the other instead of that would be great.

Mr. Waggoner

stated he doesn't see the applicant in the room but he doesn’t think he would have an issue with any of the 8.

Commissioner Lee

asked if this was submitted in the order he preferred.

Mr. Waggoner

stated this was a 2™ round of submission they couldn’t support the first set, and the owner is after a theme, and whatever we pick would fit his theme.

Commissioner Meredith

stated they choose Black Sage and Barn Owl.

Ms. Beeman

asked if the Commissioners would like to take it piece by piece or would they want to see the whole plan done?

Commissioner Lee

stated she likes the idea of pushing forward what they already completed.

Commissioner Carbone

stated he would like to see the finished plan, and he thinks the rest of the Commission will too.

Commissioner Meredith

asked when Ms. Beeman will have the full plan done?

Ms. Beeman

stated, they don’t have the census figures yet and that needs to be updated. She doesn’t know if they have gone through the entire final draft yet. They haven’t tackled the goals, objectives, and policies and need to see what new items may affect them like the underground utility plan that is now a requirement.

Commissioner Carbone

stated they are restructuring and redistricting the county, so some things may change, and the boundaries may change so maybe wait a little bit longer.

Commissioner Lee

asked if they can we take some of what they’ve worked on and schedule a public workshop? And then as redistricting happens and the rest of the census data comes in they can work on those areas as time allows.

Mr. Waggoner

stated that would be his recommendation. He would keep moving forward. He would recommend starting in with the public workshops. They did put out a survey and got a little bit of information back from that.

Ms. Beeman

stated they can schedule them right before the RPC meetings.

Commissioner Lee

asked if they want to make a schedule up for the public workshops or just do what works?

Ms. Beeman

stated they should start it next RPC meeting on November 10".

Mr. Waggoner

stated as far as the schedule they can do every other meeting or so to see how it goes. If they have a heavy agenda, then we can move it to the next meeting.

Commissioner Carbone

stated they wil! see how many people show up to the public workshops.

Commissioner Tyler

stated she won’t be able to make it to half the public workshops if they have it an hour before the normal meetings because she won’t be able to leave Las Vegas in time for it.

Mr. Waggoner

stated they can hold special meetings. That’s certainly an option for the Commissioner’s since we are together for the RPC meetings. Page 8 of 9 14.

Ms. Beeman

stated they can keep the meetings at 6 and the first hour of the meeting be the workshop.

Mr. Waggoner

stated it has been a while since they have addressed the CIP and stated he believes there was an RFP was going out.

Mr. Mulvey

stated they have submitted their PSA and it is in the approval queue they have a draft task order for the update, and they are trying to get it for the traffic updates right now.
