6. Commission/Committee/Director Reports:

Commissioner Koenig

stated they should go and check out the Museum, he is the liaison, and it is awesome. b. Director’s Report Planning applications for the month of March, total applications received was 203 which was 11 less than last month, Total applications processed was 161 which was 4 more than last month. Since July 1st 2024 to March 31, 2025 there have been 1844 planning applications and 393 new code complaints received. Compared to July 1st, 2023, to March 31st, 2024, total applications were 1762 planning applications and 355 Code compliance complaints received. Code compliance new complaints for March was 40 which is 4 less than last month, closed cases were 42 which is 20 more than last month. Total active complaints through March 31st, 2025 are 330. Building permits for March for SFR was 58 which was 10 more than last month, MF (multi-family) was 3 which was 1 more than last month, commercial was 7 which is 3 less than last month. The total permits issued in all categories was 210, which was 36 more than last month. Total inspections were 432 which was 110 more than last month. Update on the previous items heard by the BOCC, AP-25-1 was an Appeal of the Pahrump Regional Planning Commission's decision to approve Conditional Use Permit (CU-24-45) for an Animal Sanctuary on a 40-acre parcel zoned Rural Homestead (RH-9.5), located at 2380 N. Corbin St. This appeal was scheduled to be heard by the RPC at the March 18th meeting, but the Applicant of the CUP withdrew his CUP approval and in such the appeal was pulled from the agenda. Page 2 of 7 ZCMP-24-22 was an application for a Conforming Zone Change to change 2.50 acres from Neighborhood Commercial (NC) to Commercial Manufacturing (CM), to allow for a heavy equipment/crane rental business located at 3621 W Bell Vista Ave this item was heard by the RPC on March 12th and the RPC voted 6 – 0 to recommended approval to the BOCC. The BOCC will hear this item at their April 15th meeting.

reviewed her staff report stating this use is allowed with an approved CUP, upon review of the application staff finds justification to recommended approval subject to standard and special conditions listed in the staff report. Brian Regis stated he was originally going to put a duplex but with the width of the lot there was a lot of wasted space so that is why I decided to pull them apart.

Commissioner Lee

asked if the dates for site development listed in the conditions of approval to be submitted by April 9th, 2026, and approved by October 9, 2026, are okay with applicant.

stated yes, he is going to start immediately.

asked if they at some point were doing a Land Division map?

stated yes, it is complete. Juan Mendoza, representing the owners, stated as the staff member mentioned this was approved back in March, we are under review right now and due to time restrictions, we are required to review this again.

Commissioner Lee

asked the applicant if the property owner has read, understands and do they agree to the conditions as outlined in the staff report?

Mr. Mendoza

stated yes, they do.

Commissioner O’Brien

, his question has to do with flood control the fact that Gamebird road is a designated storm channel, have you worked with staff to make sure there are no issues?

Mr. Mendoza

, we are working on a drainage study with staff.

Commissioner O’Brien

, your proposal to bring traffic off a 40’ driveway, which would be East of your location is currently 65 MPH slowing down to 55 MPH, I have concerns about people trying to get out into traffic.

Mr. Mendoza

stated NDOT was involved, and they have decided to change the south driveway between Crazyhorse and Gamebird to make sure it is safe.

Commissioner Bohannon

asked if NDOT has said anything about the traffic and slow the area down.

Mr. Mendoza

stated he believes NDOT is going to be making improvements along the highway, he is not sure he is not a part of that. They have worked with NODT to make sure it is safe.

Mr. Mulvey

stated the entrance they are proposing off Frontage road is restricting left turn out.

Commissioner O’Brien

stated to staff Frontage Road is shown in this, is it a dedicated road to the county and will it remain? Will this applicant divert traffic to the Frontage Road headed up to Crazy Horse?

Mr. Mulvey

stated NDOT has specific requirements for where they can put an access. They are choosing this location because it is the center of the two streets. They don’t want one for each of the tiny parcels. There will be a cross-access easement for the parcel, and there already is, it just isn’t in this correct spot.

Commissioner Bohannon

asked the applicant how many jobs they intend to have on this project.

Mr. Mendoza

stated approximately 20 people will be employed.

Mrs. Medici

reviewed the staff report stating that Nye County Code allows for the retail sale of fireworks with the approval of a Conditional Use Permit; although the distance between the fireworks business and residential uses does not meet the Code, there are mitigating circumstances that justify approving a waiver, such as Nye County Code Title 17 (Zoning) does not distinguish between various classes or types of fireworks; “display” fireworks are the type of fireworks used in large public events such as 4th of July shows, at theme parks and major sporting events, which the applicant does not propose to sell; the proposed use is the retail sales of “consumer” fireworks only; there will be no sales of “display” fireworks; nor will there be any processing or manufacturing of any type of fireworks on the subject property. The subject location/building has already been inspected and approved for occupancy by the Nye County Building Safety Department and the Pahrump Fire Department. Red Apple Fireworks was previously approved on the adjacent parcel which they have operated from since 2011. Staff finds sufficient justification to recommend approval of the application.

Commissioner Bohannon

, asked about condition of approval number 5 it reads must comply with all county, state, and federal laws, rules and regulations are we waiving this?

stated no they are not waiving that it is just that they must comply to them. Douglas Burda stated he has nothing to add but here for any questions.

Commissioner Hayden

asked if they are going to be selling fireworks from more than one building, are they going to have different types of fireworks?

Mr. Burda

stated the purpose of this additional space Building “D” will be for VIP clients.

Commissioner Hayden

asked how traffic will be disbursed and parking?

Mr. Burda

stated they have added parking to our warehouse so they have created a cycle into the parking lot and out, the idea here will be to mitigate the heavy traffic flow. Page 5 of 7

asked about the traffic and what kind of volume they are talking about and will it be more or the same as it is now?

Mr. Burda

stated it will be more regular, our goal was really to mitigate the hazard going onto Highway 160.

reviewed the staff report stating the applicant is requesting a CUP for a 204 space RV park, this project is permissive with an approved CUP, upon review staff finds sufficient justification to recommended approval of the application subject to the conditions of approval. Russ Meads stated he is here for any questions.

Commissioner Lee

asked Mr. Meads if he agrees with dates listed for submitting CAT 1 and beginning construction are they going to be sufficient?

Mr. Meads

stated they are not after what he has found out for timing of this as it directly applies to the approval of water and sewer if they pursue onsite sewer treatment the application process requires a 12-month study for the wells in the area. To get all the information back and get it all to NDEP the process could take 21 months. Part of that process they have to explore how much it will cost to connect in to existing utilities from Great Basin Water Co. and they have now got their inquiry back. Normally they would not apply for CAT 1 until they have a conditional commitment to serve from a utility, he stated maybe they can change from 12 months to 24 and 36 months.

Commissioner Lee

asked staff if it is okay to modify the date and add updates regarding progress every 6 months. The dates would be for special condition #8 from 12 months to 24 months and # 10 from 18 months to 36 months.

stated it is okay to modify the dates.

asked the applicant if he has read, understands and agree with conditions of approval?
