Commissioner Lee

interrupted Mrs. Gilbert stating that it is not something under the scope of this board. Patricia Robb stated this does concern you and after the last Board of County Commissioner’s meeting the board acknowledged the need to meet with the Planning Department to address the zoning of the zombie lots where Public utilities do not exist and asked if this meeting has happened and where does it stand. It is the County Commissioners that have the power to change the restrictive VR zoning due to the mass amount of parcel’s Page 1 of 7 affected by using their authority under NCC 17.04.950 as permitted by NRS 278.250 which is further supported by the senate bill 150 allowing off grid homes with alternative utilities gives these lots purpose again. This has become my calling to find a way to help our town and these property owners. For the sake of everyone we need to change the VR zoning. Ther is no time left for excuses, some of the property owners have gotten together and meant with a legal advocacy team to pursue legal action.

Commissioner Lee

stated she submitted some minor typographical corrections to staff which have no bearing on the context of the minutes.

Commissioner Kerr

stated she did watch the May meeting and she can vote if needed. Public comment opened and closed at 6:06 pm with no comments.

stated they are asking to pull item 7 until a later date and when item 8 comes up the applicant has requested a continuance.

congratulated Commissioner Kerr on her appointment to the RPC. Commission/Committee/Director Reports: a. BOCC Liaison Report

Commissioner Koenig

stated at the last RPC meeting the item on the gas station was very upsetting to him. Their job is land use not figuring out parking or getting in and out of a car wash, that is not part of the agenda. If you pay attention to the Agenda, it says this is for the conditional use of a gas station all other development will go through Site Development and in accordance with NDOT. You all had the opportunity to go over this with staff. He does not want their interest or likes or dislikes to influence their decision. These people go out and spend millions to do this development, your job is land use. He stated if you’re going to vote “no” they will have to find alternative findings, which makes it difficult. The project is required to obtain an approved Page 2 of 7 Cat I Site development, which includes parking, egress, landscaping, traffic, etc. They need to stop going off track and making something take longer than needed. b. _Director’s Report

Mrs. Sandoval

stated Planning applications for the month of May, total applications received was 227 which was 29 less than last month. Total applications processed was 121 which was 59 less than last month. Since July 1° 2024 to May 31, 2025 there have been 2,318 planning applications and 516 new code complaints received. Compared to July 18, 2023, to May 31“, 2024, total applications were 2,214 planning applications, and 460 Code compliance complaints received. Code compliance new complaints for May was 65 which is 5 more than last month, closed cases were 36, which is 2 less than last month. Total active complaints through April 30", 2025, are 368. Building permits for May for SFR was 37 which was12 less than last month, MF (multi-family) was 6 which was 9 less than last month, commercial was 12 which is 3 more than last month. The total permits issued in all categories was 171, which was 15 less than last month. Total inspections were 432 which was 83 less than last month. Update on Previous items heard by the RPC AP-25-3 was an appeal of the RPC decision to deny a reconsideration of conditions of approval for CU-24-4 to remove the billboard/superstructure at 5511 S. Nevada Hwy 160. This was heard at the May 20th BOCC meeting and the BOCC voted to affirm the RPC decision of denial with a 3 — 2 vote. ZCMP-25-1 was a conforming zone change from VR-10 to NC to allow for a New Public Storage Facility located at 4061 E Dandelion St. It was heard at the May 14 RPC meeting and the RPC voted 4 - 0 to recommended approval to the BOCC. This item will be heard at the June 17, at the BOCC meeting. ZCMP-25-3 was a Conforming Zone Change NC to RE-1 to allow for a SFR to be built at 1021 E Manse Rd. It was heard at the May 14 RPC meeting and the RPC voted 4 - 0 to recommended approval to the BOCC. This item will be heard at the June 17, at the BOCC meeting. For Possible Action — AB-24-7: Public Hearing, discussion, and deliberation on an application requesting abandonment of a public utility easement is being submitted to vacate portions of the public utility easement granted per file 591683, file 620660, file 670229, and file 707584 of Nye County, Nevada, Official Records. Located at 3620 E. Manse Rd., Pahrump, NV. Assessor’s Parcel Number 045-501-23. Mountain Falls, LLC Property Owner. Rebecca Chiriboga, Taney Engineering — Agent / Applicant. (This item is Final Action by the Pahrump Regional Planning Commission unless appealed to the Board of County Commissioners, or as otherwise announced.) (QM) Item pulled. reviewed the staff report stating that both of these items were heard back at the June 12, 2024 meeting they are asking to reconsider special condition #7 asking for a 9-month extension. They are in the process and just need more time, the new expiration date would be March 12" 2026.

asked if the applicant needs to be here for action to be taken?

stated they have the option to take action on the item or continue it if they have questions for the applicant.

asked the other Commissioners if they have any questions?

asked staff if the issue was with Great Basin Water and getting everything confirmed and completed.

Commissioner Tyler

asked staff if the 9-month extension is enough time?

stated yes, and they can apply for another extension if needed. Public comment opened and closed at 6:23 pm with no comments.

Mrs. Medici

reviewed the staff report recommending approval for the waiver to allow a ten-foot block wall, remove the landscape requirement for the tower area only, as the area will be blocked by the wall, and to allow for upward facing lighting for emergency repairs.

Commissioner Bohannon

disclosed he is an attendee at this chapel, he is not a member, and he does not see an impact on this decision.

Commissioner O’Brien

asked if the 10’ wall is the tower area only and can we add that to the motion?

Mrs. Medici

stated yes. John Gundacker stated they want to build wall only for safety and vandalism.

Commissioner Lee

stated for clarification, it is the lighting permanently affixed to the tower but only illuminated in the event of emergency repairs at nighttime?

asked have you read and do you agree with the conditions as outlined in the staff report?

Mrs. Medici

reviewed the staff report recommending denial based on the requested Zone Change to HI is not clearly specified in the Justification Letter and cannot be recommended for approval to the BOCC without a clear path forward for development. The LI zoning district allows for several types of business ventures under Permissive Uses and Uses Subject to a Conditional Use Permit. The uses in HI are more intensive and could result in incompatibility for neighboring parcel development. Bryce Dahlin states the owner of this project is looking to invest in the Pahrump area and wanted to switch the zoning of these parcels over to HI for more flexibility for the uses on the properties. This extends his marketing ability to find companies that are looking to move out of the Las Vegas area or new to Nevada. In summary we are looking for the flexibility of having the HI zoning for better marketing for the properties.

Commissioner Tyler

states before we would approve something as HI she would really like to know what type of HI we would ne approving, she does not feel comfortable putting it in place without knowing what is proposed.

Commissioner Lee

stated she agrees with Commissioner Tyler.

Commissioner Bohanon

stated when he was looking at this, he sees no reason to change the zoning.

Commissioner O’Brien

stated they already approved apartments going in behind this on Basin Road and directly behind these parcels it is zoned LI all the way down to Home Depot. He looked at what we have already approved and he does not see this as a conforming application.

Commissioner Hayden

stated she agrees and she is uncomfortable approving something with so little information.

Commissioner Koenig

stated they are constantly looking for opportunities to create more jobs here in Pahrump, however some of the uses for HI do not fit in this area and he agrees with the Planning staff on this.
