8. For Possible Action – WV-26-9: Public Hearing, discussion, and deliberation on an application for a Waiver

Mrs. Sandoval

reviewed the staff report stating that this is a waiver to allow two existing accessory structures to remain with a reduced side yard setback. One structure is currently located approximately two feet from the property line, and the other is 1 foot 9” from the property line where a minimum 5-foot setback is required. The structures were present at the time of purchase with no County approval and have since been improved. The applicant acknowledges it cannot be used for residential or short-term rental and will be limited to storage as an accessory use. Staff is recommending denial as the requested reduction is significant and does not meet the intent of the setback requirements. While the applicant has stated financial hardship, that alone is not sufficient to justify this waiver.

Commissioner Bohannon

asked staff was there any grandfathering that was taking place with this?

Mrs. Sandoval

stated one of the structures started out there when he brought the property the rest he has added since purchasing the property. It came over as a code case as they were being used as short term rentals. The owner does acknowledge it was there when he bought the property and he has added onto it.

Commissioner Kerr

asked about the adjacent property and him owing that parcel, can he combine the lots to get rid of this problem?

Mrs. Sandoval

stated she believes the owner wants to keep them separate as he has future plans to build a single- family residence on the adjacent property, but yes that would solve the problem. Allen Cunningham stated he wanted to reiterate that the building has been in place since 2004 and the other structure that is in question has been removed. There is a fence that separates both properties and he does not believe the fence is accurately placed and the measurements are being taken off that fence. He did not realize until recently that the properties should be surveyed to verify if the fence is in the correct place and there may be a variance there of five feet. The building is not creating a safety issue, nuisance, or public safety issue.

Commissioner Tyler

asked Mr. Cunnigham which building was removed?

Mr. Cunnigham

stated the one that is towards the front by the septic tank the one north of that was the one removed.

Commissioner Tyler

stated so the only one you need a waiver is one that is shed #2?

Mr. Cunnigham

stated yes that is correct.

Commissioner Bohannon

stated one of his concerns is that Mr. Cunningham stated the fence may be misplaced. How did you come up to that finding?

Mr. Cunningham

stated he was looking at the GIS, when he took the measurements, it seemed to be about 7 feet.

Commissioner Kerr

stated there would not be any harm in continuing this and asking them to do a survey and bring this back once the survey has been completed, because then a waiver may not be needed.

Commissioner O’Brien

asked is there any utilities hooked to this shed?

Mr. Cunnigham

stated there is water, power, and electricity to the shed. The owner is aware those items would require the permits.

9. For Possible Action – CU-26-9: Public Hearing, discussion and deliberation on an application for a Conditional

Commissioner Hayden

stated on page 4 it states if to approve events would be between 7 am – 10 pm and follow NRS 574.100 and it was repealed in 2001. She can’t find the new NRS for it, she wasn’t sure what that refers too as that is not a valid statue anymore. Commission O’Brien asked staff what the requirements are for parking, since it is gravel is he required to do anything for dust.

stated Mr. Ortiz has asked him to translate for him since he only speaks Spanish.

Mr. Escobodo

stated Mr. Ortiz would just like to thank you for taking this into consideration. This is a sport that is cultural for his family, it is something they have been practicing for many years. We do everything we can for animal welfare, we want to be able to continue this sport.

asked the applicant if they have read, agree, and understand the conditions of approval.

stated Mr. Ortiz would like to add a condition to hours of 9 am – 11 pm, is this possible?

Commissioner Tyler

stated we can consider that, she thinks we can leave it to 7 am and just add the extra hour as requested.

asked about the federation what is that name again?

Mr. Escobodo

stated it is the Mexicana of Charreria (FMCH).

Commissioner Bohannon

asked what events are you planning on doing?

Mr. Escobodo

stated there are 10 events and we plan on doing all of them.

Commissioner Bohannon

asked for the record if there would be any tripping that would be going on?

Mr. Escobodo

stated no, in the state of Nevada and California it is not allowed.

Commissioner O’Brien

asked is there any plans for lighting?

Mr. Escobodo

stated lighting exist in the arena now. Page 4 of 7

Commissioner Hayden

stated this item was brought before us in 2024 and what would be different this time? In the last meeting there were several emergency calls reported at these events, but safety needs to be a concern.

Mr. Escobodo

stated there is confusion, there is a facility about 2 miles away and he thinks that is where these calls were from, it is not the same ranch.

Commissioner Hayden

stated for clarification when she looked at the drawing there are 2 metal corrals, so you have maybe 2 horses of your own 1 in each corral?

Mr. Escobodo

stated Mr. Oritz has 2 barns with 16 stables and he only has 3 horses of his own.

Commissioner Hayden

asked is your main focus going to be training such as riding lessons or roping events?

Mr. Escobodo

stated when there is events they will be arriving and leaving that same day, he can keep the horses overnight if needed for accommodation.

Commissioner Hayden

asked how many events per year do you think you might have?

Mr. Escobodo

stated they are asking for four events. They have to bid on the events, so they are hoping to get at least four. It will be open to the public to watch these events.

Commissioner Bohannon

asked how many horses at one time will there be at these events? Jose Baustita stated he is helping with the events. People go in and out after each event, the events have 3 hour sessions. We have a really nice facility, we handle 80- 100 total public and participants and 30 – 40 horses will stay overnight during these events.

stated from a traffic standpoint what will it look like?

Mr. Escobodo

stated there are security guards at the gates they help everyone with getting out safely with their trailers. They all park onsite, there are 2 sections for parking, one for trailers and one for cars.

stated the applicant would like to continue the applications for 6 months to find a commercial property to move the business too. Jennifer Gaynor on behalf of the applicant stated she agrees with everything staff has said and would ask for this 6 month continuance.
