Commissioner Kerr
stated one of the conditions is that if this is approved the questioning shed would be removed if the property is sold.
Mrs. Ward
stated yes that is correct and they are okay with that condition.
Commissioner Bohannon
asked why should we grant a waiver?
Mrs. Ward
stated he does own both pieces of property, when the property was purchased, he was not aware the shed was too close to the property line. Page 2 of 14

asked District Attorney Brian Kunzi it states in the special conditions both parcels but does not list both in the waiver?
Mr. Kunzi
stated you can only take action on the parcel listed on the agenda.
Commissioner Tyler
asked have you read, understand, and agree to the conditions in the staff report.
Commissioner Ewing
asked staff what is in place to ensure the shed would be removed if the property is sold?
Mrs. Sandoval
stated that any conditions that are placed on a parcel we have triggers that will trigger staff, we would then send the building department out to verify. This structure is actually on a pad so it cannot be moved.
Commissioner Bohannon
stated staff’s recommendation is denial, so if we are going to approve this, we will have to find alternate findings.
Commissioner Hayden
stated she can see having him moved the shed, but should he ever decide to sell the property the new owner should have some kind of notice.
Commissioner Tyler
stated are we setting a precedence allowing this shed to encroach that far into the required setback, whether he owns the other parcel or not is immaterial unless he were to combine them. It violates the codes we have in place for setbacks.
Commissioner O’Brien
stated they have a choice they can merge the two properties together.
8. For Possible Action – AB-26-1: Public Hearing, discussion and deliberation on an application requesting

asked staff about the VEA comments that they do have utilities within the right of way, and ATT says they also have utility structures in this right of way has this been taken into consideration?

stated yes, they are in the special conditions. The applicant has been in contact with these companies, and they have worked through these issues. Rebbecca Chiriboga stated she is representing the applicant. As mentioned, we have been in contact with the utility companies, and she can answer any questions you may have.
9. For Possible Action – CU-26-6: Public Hearing, discussion, and deliberation on an application for a
Mrs. Medici
reviewed the staff report stating that the applicant is requesting a Conditional Use Permit to allow a Watchman’s/Caretakers Residence on the property for an Auto Repair Facility. The property is zoned Commercial Manufacturing (CM), and the proposed use is allowed within this zoning district with a Conditional Use Permit. On 10/8/25, the Zoning Administrator determined the auto repair shop was not grandfathered as documentation was not provided showing the auto repair shop was continuously licensed to operate with the State of Nevada and the Town of Pahrump since originally closed in 2017. The County also verified that no business license was issued to the subject property after 2017 and there was no State of Nevada DMV Registration which is also required to operate a legal auto facility. In Commercial Manufacturing, an auto repair shop is a permissive use. The applicant must apply for and obtain an approved CAT II Site Development Plan. With approval of the site development the applicant can operate the repair shop once all applicable permits and licenses are in place. Approval of this application will allow the applicant to utilize the residence as a watchman’s/caretaker residence. Upon review of the application staff finds sufficient justification to recommend approval of the watchman’s quarters.

asked how long they have been out of compliance with the Business License?

stated since 2017.
Commissioner O’Brien
asked what structure is this proposed watchman’s quarters? Jason Gettle stated the watchman’s quarters is a stick-built home. The previous ball drops he was never notified, he had a previous business owner at the time, and everything was going to him. The previous owner that was operating had let the license lapse and we were not aware. He stated he was not notified about site development he did not get the flood study done in time and he was told he would have to start Page 4 of 14 over. He also tried to apply for grandfathering which was also denied. He was not aware this was for the approval of the watchman’s quarters tonight, that is not what he applied for or paid for.

stated it cannot be grandfathered when the business has not been legal since 2017.
Commissioner Bohannon
asked how long the business has been operating?
Mr. Gettle
stated he has a full mechanic’s license, he purchased property 4 years ago and he got a mobile mechanic’s license. Harley Kulkin stated of the things he is hearing have been incorrect. When he sold his business, they continued to operate under his license until they got their own. Having a license or not does mean you have not done business. If I do not have a business license and I am still conducting business I may be doing business without a license, but I am still doing business. This property has never stopped doing business. He has tried to comply with everything he has been asked to do. We are not here to stop businesses from operating.

stated this item is only for a watchman’s quarters only.

asked Mr. Gettle if he has read, understand, and agree to the conditions as written in the staff report?

stated he didn’t read it and has no idea what they are.
Commissioner Bohannon
asked about the special condition to submit a site development application? It has been mentioned that site development was started and may not have been completed.
Mr. Gettle
stated he has no idea.

asked if there is an impact if we take another month to bring this back on next month’s agenda?
Mrs. Sandoval
stated as of right now he has a cease-and-desist order so he is not allowed to operate on the property, this would have helped him to move forward with getting his licenses that are required.
10. For Possible Action- CU-26-14: Public Hearing, discussion, and deliberation on an application for a

reviewed the staff report stating that this is an application to allow dog and cat breeding operation. The proposed use includes the breeding of Maine Coon cats and Golden Retrievers, with animals housed and maintained on site by the property owner. Upon review of the application staff finds sufficient justification to recommend approval of the application. Page 5 of 14

asked about the issues they have had in the past.
Mrs. Marshall
stated she is not aware of the issues, Kristi with animal control would be better to answer that. We do have the statement Kristi provided in the back-up. Amanda Christiansen stated she wants to start with her background she is not new to breeding she has been doing this her whole life. She started her golden retriever program 20 years ago and the Miane Coons about 3 years ago. She stays at home full time, all her animals are health tested and show titled, She currently has 8 dogs and did when animal control came out twice in January and 2 cats. She is asking for 10 cats for genetics to be able to have flexibility. Three of her dogs out of the eight will be retired this year and going to good homes then she will be replacing them with new younger dogs. She had not had any issues with any of her neighbors. All her dogs and cats live inside, other than just going out to use the bathroom and play time. There are no kennels or buildings set up, they just live inside as part of our family. She spoke with Kristi at animal control and they spoke about the calls reporting caged animals in her garage, She explained those cages are Catio’s which is an enclosure for the cates to be able to get fresh air outside so they do not run the neighborhood. She is willing to comply with all permits and animal services. She stated she agrees to all the conditions except for the amount of dog litters she would like it to be three instead of 2.

asked about the incidents that have occurred?

stated both complaints revolved around the cats.

asked about the 3 litters of puppies, how many possible animals are we talking about with the cats and dogs?
Mrs. Christiansen
stated we have a larger house and we have a converted 3 car garage that is temperature controlled. On average she has 3-9 kittens per year and with the dogs 18 puppies per year.
Commissioner Tyler
stated the applicant did agree to the conditions other than wanting to have 3 litters of puppies instead of 2.
11. For Possible Action – CU-26-15: Public Hearing, discussion, and deliberation on an application for a

reviewed the staff report stating that this is an application to allow a Commercial Stable dedicated to providing equine-based experiences, including horseback riding lessons, therapeutic riding opportunities, and guided trail rides. Upon review of the application staff finds sufficient justification to recommend approval.

asked staff about the Cease and Desist although it been paid it is still open when will that be closed? Page 6 of 14
Mrs. Marshall
stated when they come into compliance with the applicable permits. Jeanne Hamerly stated she is a nonprofit 501c3 and she is the director of Sundance Ranch. The organization focuses on trial ride, lessons, and providing equine therapy. We would like to cater to the military and first responders. We have special needs children that come to the ranch. We had a clerical error, we have always been compliant with the state. We just did not know about the Pahrump town license. We are not high traffic, we do not have a lot of activity, we have 5 horses right now.
Commissioner Hayen
asked about her horses and who they belong too. Is it your intention to just have 5 horses, do you intend to board any horses, how many people do you have come and take lessons at a time?
Mrs. Hamerly
stated they belong to Nevada Sundance Ranch. She does not board any horses, we just lost a horse, and we may replace that horse but that would be the only one. The lessons are private, so there is not a lot of traffic.
Commissioner Hayden
asked where do you do these lessons, and what about manure?
Mrs. Hamerly
stated we have an arena, and we have a dumpster for the manure.

asked Mrs. Hamerly if she has read, understand, and agree to the conditions as written in the staff report.

stated yes. Dara Tahler asked what the conditions were as they did not see them?

asked about where they do trial riding? Do you have children with disabilities that come to the Ranch?

stated we have permission to do it on BLM land and that is where we do the riding. Yes, we do have special needs children that come to our facility.

asked about the sizing of the property and horses?

stated we have 5 horses total.

stated every morning they graze on hay while we clean their stalls and refresh their water, then we bring them back into the covered pens around 1 pm. The community has donated a lot of food for the horses as we do not have a lot of money as we are non-profit.
12. For Possible Action – CU-26-16: Public Hearing, discussion, and deliberation on an application for a

reviewed the staff report stating that the applicant is requesting a Conditional Use Permit to allow for a professional private shooting range on a portion of the 10-acre parcel that contains a gravel pit. Upon review of the application staff finds sufficient justification to recommend approval of this application. When this item was noticed there is actually 2 parcels that show up on the site plan, tonight we will only here 7691 Gahn then next month we will hear the other parcel. Travis Shelton stated the Town of Pahrump needs this shooting range. He is a law shield instructor and also worked at frontsight. He has been doing training for the Town of Pahrump for over a decade now. He needs a place to do this training, he hates to see the desert with all the trash where people have been shooting.

asked about safety?
Mr. Shelton
stated there will be 50-yard perimeter with 20-foot berm barriers to handle any ricochet, there will always be supervision. Everyone will be properly trained and will sign waivers.
Commissioner Ewing
asked will there be memberships?
Mr. Shelton
stated yes as well as daily shooting fees.
Commissioner O’Brien
asked about the ballistics that will be used will they be limited?
Mr. Shelton
stated he is only going to allow 50 calibers, that is what you will be able to shoot to not have any safety issues.
Commissioner O’Brien
asked about arrangements with the fire chief?
Mr. Shelton
stated yes, he will be working with the fire chief.

13. For Possible Action – WV-26-12: Public Hearing, discussion, and deliberation on a Waiver application,
Mrs. Marshall
reviewed the staff report stating that the applicant is requesting a Waiver from landscaping and parking on 2 parcels zoned General Commercial. The applicant is required to go through Site Development as they are proposing development of vacant land. Upon review of the application staff finds sufficient justification to recommend Denial as the applicant has not provided sufficient hardship for the waiver request.

asked what the minimum requirements to establish a parking lot for this parcel? Steve Osborne stated the minimum requirement is chip-sealed.
Commissioner O’Brien
stated he was up there this afternoon and 2 inches under the soil is poof dirt. Luis Espinoza stated Switch business solutions are regulated and is proposing to construct an unmanned structure not open to the public intended to provide necessary infrastructure for the government and State to support several entities. This will support hospitals and schools. The paved parking standards would create a substantial cost which could make this project delayed.

stated yes, he is willing to comply with all the conditions.
Commissioner Bohannon
asked why should we approve this waiver?
Mr. Espinoza
stated there will be minimal traffic with a substantial cost for paving with no benefit. The development is an unmanned utility structure not open to the public. There is no water to this site, and if installed if there is a leak there would be no one there to fix it which would be wasteful. We do have in the plans to put xeriscapes as well as slats in the fencing.
Commissioner Simunick
asked when you say xeriscape what do you mean?
Mr. Espinoza
stated mostly rock.
Commissioner Simunick
stated we have a list of plants that do not require water.
Mr. Espinoza
stated we will not have a team to go and maintain landscaping at the site.
Commissioner Tyler
stated the parcels next to this project are all vacant, it is not next to that bar.

stated in the past with utilities we have allowed not to have to put in a water line because when it is something that uses fiber, data, or power which can be damaging to all those processes on their lot.
Commissioner Bohannon
stated he believes there are plants that can be placed that do not need water.
Commissioner Simunick
stated but if it is not open to the public and it is an unmanned station she does not understand why it would need all these things. It is going to be fully fenced, with no employees. So, what would it matter if it is paved and landscaped.
Mr. Espinoza
stated they will only be out at the facility once a month or quarterly. Tyler Mulvey stated the parcel a crossed the street for the Verofiber was approved without having to pave or landscape.
Commissioner Tyler
stated so what Mr. Mulvey is saying we set a precedence with the neighboring property, so that can be our alternate finding.
Commissioner Kerr
asked Mr. Espinoza about the last sheet in the backup has a site plan, and it has parking is that what you attend to do if the waiver is denied?
Commissioner Ewing
asked there is a proposed diesel generator and what are your plans for fire suppression.
Mr. Espinoza
stated we have crews that go monthly and we do have fire suppression inside the facility.
Commissioner Bohannon
stated so if there was a fire it is going to burn until our emergency crew can arrive.
Mr. Espinoza
stated everything is monitored daily.

stated all of that will be addressed during site development.
14. For Possible Action – WV-26-13: Public Hearing, discussion, and deliberation on a Waiver application,

reviewed the staff report stating that the applicant is requesting a Waiver for drive aisles to be gravel or chip seal, rather than an asphalt surface on a property zoned General Commercial. The applicant will be required to go through Cat 1 Site Development before any activity can take place on the lot. Upon review of the application staff finds sufficient justification to Approval as the applicant has provided sufficient hardship for the waiver request. Heather Daun and Paula Glidden stated we are here if there are any questions.

15. For Possible Action – WV-26-14: Public Hearing, discussion, and deliberation on a Waiver application,

reviewed the staff report stating that the applicant is required to go through a CAT 1 Site Development per their Final Action Memo for Special Use Permit ETSU-24-3 special condition #2 grantee shall apply for and obtain approval of a Site Development Plan. The applicant is requesting a Waiver from parking, landscaping, and lighting. Upon review of the application staff finds sufficient justification to recommend Approval, as the applicant has provided sufficient justification for the Waiver request. Larry Bitton stated he is representing Gridliance stated he agrees to all the conditions as written in the staff report.

asked if they are okay with the 12 months’ timeline for the site development?

stated yes, they are anxious to get this project started.

reviewed the staff report stating that the applicant is requesting a Waiver from parking, landscaping, and lighting. The applicant is required to go through a Site Development per their approved Special Use Permit ETSU-24-4. Upon review of the application staff finds sufficient justification to recommend Approval, as the applicant has provided sufficient justification for the Waiver request. Larry Bitton stated he has read, understands, and agrees to all the conditions in the staff report.

reviewed the staff reports stating that Richmond American Homes Nevada is requesting to install/permit one off premise sign per application. The applicant is also requesting a Waiver to allow the sign to be located more than one hundred feet from any highway. Upon review of the application staff finds sufficient justification to recommend approval of these applications.

asked if this is the last set of these existing signs that were not in compliance?

asked are the signs already up and what about all the flags being placed?
Mrs. Sandoval
stated yes they are. They applied for their TUP’S while waiting to get these applications approved and the flags have been addressed by Mr. Perez. Thomas Perez stated he works for Fusion signs and he is here to get these signs approved. He is not sure about any A-frame signs, but he can ask about them, he was not informed of the flags being placed until he was notified they needed to come down and he took them down that same day.

stated from a workshop standpoint there are a lot of people saying they have not seen anything regarding licensing. Communication is very important and making sure our citizens understand what the rules are even if they are taking over another business. Page 13 of 14
