Mr. Gettle
stated regarding #13 getting the DMV license in 30 days it would take more time than that, he would need at least 120 days. It says any cars that don’t move for more than a week will need to be behind a fence, no other shops have that stipulation.

verified with the applicant that the property is fenced.
Mr. Osborne
stated that this a stipulation currently in code that any vehicles that are not moved for 1 week or more adjacent to a residential zone must be screened with privacy fencing.
Mr. Gettle
stated that the residential zoned property that is behind him they have already have a screened 6-foot privacy fence between us.
Mr. Osborne
stated if you have a privacy fence in place then you have meant condition #9.
Mr. Gettle
stated all the dismantled vehicles have been moved or are in process of being moved. He would like 60 days to get the rest removed. The reason why he never got the Cat II site development done is it is for a new project and his project everything there exists. Can this be reduced to a CAT III? He then asked if # 11 can be removed as it states the Planning can add stipulations as needed. Brian Kunzi stated # 11 is a standard condition on applications.

stated he already has a site plan in, it just does not meet all the requirements, we can get with the applicant and go over it with him.
Mr. Mulvey
stated that for Public works Cat I and II are basically the same thing, if you are just trying to accept a site plan it has been done through CAT III before. Harley Kulkin stated for four years Mr. Gettle has been trying to get through this, no matter what he does something else pops up he believes #11 needs to go away.

stated at this time we will cannot remove #1 1, we are trying to get this move forward so he can get approved. He asked Director Osborne if we can switch to Cat III?

stated yes that we can switch to Cat III.

asked Mr. Gettle if he was satisfied with all the issues?

reviewed the staff report stating that this is an additional parcel for CU-26-16 that was left off inadvertently from the May 13, 2026 PRPC meeting. The applicant is proposing a privately operated outdoor shooting range. Upon review of the application staff recommends Approval of this application to include APN 027-031-01. Travis Shelton stated he did have a question about the 30 feet of ROW?
Mr. Mulvey
stated he needs to have a dedicated driveway. He needs to talk to NDOT about using that access through BLM. If you couldn’t get access through BLM, you would have to get access off Gahn drive.
Commissioner O’Brien
stated have you read, understand, and agree to all the conditions as written in the staff report?

stated to change condition #6 to be contingent on NDOT or BLM approval. Public comment opened and closed at 6:54 pm with no comments.

stated he would recommend continuing this item or denying it.

stated they have submitted a conceptual site development plan that was previously approved by this board.

stated they have 2 options, either start over or appeal it to the BOCC.

stated it is a problem that the applicant is not here to agree to the conditions.
Mrs. Marshall
reviewed the staff report stating that this application in an Appeal of the Zoning Administrator’s determination that having livestock is not in compliance with the PRPD Zoning Ordinances, on a property zoned Village Residential (VR-8). Staff recommends to Affirm the decision of the Zoning Administrator. Joshua Fanning stated he is here regarding this appeal of our backyard chickens not being able to be kept in the VR-8 zoning district. We have never observed rats or rodents around our chicken coop. He can only speak to his property, and it is kept very clean. However, he believes that is not the issue the issue is whether or not a few hens should be considered livestock. A lot of communities have already recognized this distinction, and they allow up to 7 hens on a residential lot. This zoning code seems to focus on cats and dogs when people have rabbits, guinea pigs, etc. Our daughter helps take care of the hens every day, they are our pets. He respectfully asks this issue gets reviewed. Page 5 of 16 11. Teagan Fanning stated the chickens are her pets, she takes care of them every day. She has learned how to care for the chickens and the responsibility of caring for them. She keeps the coop very clean and respects her neighbors. She asks that they be allowed to keep their chickens because they mean a lot to her.

stated he does remember this being visited about a year ago and we have asked that it get looked at once again. Having been on a farm it was a great learning experience for him, sometimes the rules do not make sense.
Mrs. Marshall
reviewed the staff report stating that the applicant is requesting a waiver to allow additional time beyond the six-month abandonment timeline for a legal nonconforming, or grandfathered, casino use located at 771 S. Nevada Highway 160. The applicant intends to continue the existing casino operations and Page 6 of 16 12. is requesting additional time to complete permitting, tenant improvements, interior and exterior renovations, and facade changes without the use being considered abandoned under the six-month limitation for grandfathered uses. Upon review of the application staff finds sufficient justification to recommend approval of WV-26-16. Marissa Fehrman stated as you all are aware this property was previously operated as Gold Town casino, the property owner has decided to take it back and renovate to modern times, the service station as well as the convenience store will be reverted back to a Terribles along with the casino. This request just gives the applicant a buffer in case the updates to the building take longer than 6 months. The applicant is ready to move on the property as soon as permits are underway, with a projected opening day of March-April of 2027.

Harley Kulkin stated we are here to help business and people be productive members of the community. They need time to get the building renovated. He recommends passing this waiver and bring more progress to our community. Beth Borysewich stated she is in favor of this, Terribles Herbst has been a neighbor to different towns in Southern Nevada. It will bring jobs, and additional restaurants to Pahrump.
Commissioner Bohannon
asked how many jobs are expected? Will the gas line be dormant until you are up and running? What will be the impact on the drive through on the property?
Mrs. Fehrman
stated 8-10 additional parking spaces will be placed, it is currently closed so the gas line is dormant currently, we do not have a set number of jobs.
Commissioner O’Brien
stated the gas sign is still illuminated, people drive in then realize it is closed if we can get that taken care of.

stated yes that she will get that taken care of and the sign shut off.

reviewed the staff report stating that this is an application for a waiver to waive parking and landscaping requirements. The applicant proposes to construct a commercial access apron at State Street, with Page 7 of 16 13. a gravel access drive extending from the ROW to the tower compound. Upon review of the application staff finds sufficient justification to recommend approval of WV-26-17. Cornelius Whitehead stated he is with Atlas towers. He wanted to state this project is a telecommunication tower on a vacant parcel. This project will not have any employees, customers, water or sewer services. We are proposing a gravel accessed drive to the compound for maintenance or emergency services.
Mr. Whitehead
stated it is an unmanned wireless communication facility it is planned for Verizon wireless, it will be able to accommodate T-Mobile as well as AT&T. This is a mobile cell phone tower, most cell towers are a mix of 5G to provide faster service. The antennas are regulated by the federal communication commission.

asked if this tower should fall would it stay inside the property line.
Mr. Whitehead
stated it does not, none of our towers have ever fallen, they are designed to withstand hurricane force wind.
Mrs. Marshall
reviewed the staff report stating these are applications for waivers from landscaping, parking, and lighting. The applicant is required to go through a CAT I Site Development per their Final Action Memo for Special Use Permit ETSU-24-3. Upon review of the applications staff finds sufficient justification to recommend approval. Larry Bitton stated he is representing Gridliance. This application is in front of you tonight as a condition of our site development process even though the properties are outside of the Pahrump area. He stated the applicant has reviewed all the conditions and they agree, understand, and have read all the conditions in the staff report.
Mr. Bitton
stated the lighting is for emergency and maintenance operations only. If there is any ongoing lighting they will all be shielded and downfacing lights, all the stations are substantially away from any residential areas. All of the stations are also substantially set back from the individual parcel lines for the property. Regarding the landscaping, there is already natural landscaping, to put other landscaping would Page 9 of 16 14, 15. require a lot of irrigation which does not make sense for a substation. This request for the waivers is not financial it is more a logical request. Dark skies will be maintained, other than in an emergency situation.

stated that vegetation inside a substation is not conducive as well as water around electrical.

reviewed the staff report stating that Item A is a request for a Major Master Plan Amendment to change two parcels totaling eighty acres for RDR to SPD to conform with applications for a conforming Zone Change. Items B-F are requesting Zone Changes on Twenty-seven parcels totaling approximately 764.36 acres from SP, VR-20, GC, and NC to LI. The owner is proposing the Major Master Plan Amendment and Zone Changes in order to facilitate the development of data centers. These applications were received by the Planning Department in April 2026, Prior to the BOCC decision on June 2ncd, 2026, to impose a Moratorium on all new applications relating to data centers. Upon review of the applications staff recommends approval to the BOCC. Russ Meads stated he believes everyone knows why we are tonight, it is unusual, but he thinks it might be appropriate to take public comment first then he can speak and answer the questions.
Mr. Meads
stated he wanted to clarify that there is no residential proposed with these zoning and masterplan changes only a data center. He stated he also wanted to clarify Adaven is not associated with this project. He then gave an overview of the project, he talked about water usage and contamination concerns, the benefits to a nearby college as far as help with the infrastructure needed for the college, and the financial benefits and added infrastructure for the County.

talked about the Masterplan and as a board what decision make sense for the community and following the Masterplan.
Commissioner Bohannon
stated there are some concerns he would like to get addressed such as chemical run- off for the area. If this zoning gets changed, there are many other uses that if this facility did not happen there are other uses that can go onto this property that could create a challenge for this area.
Commissioner Kerr
stated that for us to make a decision right now is premature, she believes there should be more time to develop an ordinance to set standards for this type of project. Page 13 of 16 16.
Mr. Koenig
stated the BOCC is currently in the process of creating an ordinance that will replace the moratorium for data centers.
Mr. Kunzi
clarified that an ordinance is going to be the next step.
Commissioner Bohannon
stated there is too much unknown at this time for a decision to be made.
Mr. Meads
stated by recommending approval to the BOCC does not allow the property to be used as anything other than this proposed use. If this project does not move forward, it reverts back to SP zoning. A development agreement will be part of this project, by giving approval of changing this zoning one of the conditions is that we do a development agreement.
Mr. Kunzi
verified that Mr. Meads statement is accurate regarding a development agreement. Recess taken at 9:59 pm. Meeting called back to order at 10:09 pm.

stated an approved water source would require the property owners to have a well and water rights or tie into the public water system this has been needed on all other lots in Pahrump. Other property owners have paid a lot of money for water rights and or tie into the public water system. The roads are not built in these areas which can create an issue with dust.
