called the meeting to order at 8:33 a.m.

Commissioner Carbone

motioned to approve the minutes as written. Mr. Cameron McRae second. Approved 3-0.

Commissioner Carbone

motioned to accept the RTC Board Chair as it is today that Dan Schinhofen be the Chair for the next year. Mr. McRae second. Approved 3-0.

Commissioner Schinhofen

motioned to appoint Frank Carbone as the Vice Chair for the next year. Mr. McRae second. Approved 3-0.

Mr. Dave

Fanning from Nye County Public Works stated that this item was brought to the Board back in December of 2013. The main thing that we need at this time is the review from the DA that was submitted back in December for the right of ways. We have not heard anything back as of this time. Mr. Fanning stated that we have a few options. We can redo the road in its current configuration, we can condemn the Regional Transportation Commission – Minutes March 18, 2014 property or we can buy out a piece of the right of way on Jean on the west side down to Manse. On the east side of what we do own is about 40 feet. Mr. McRae thinks that we should get the right of way so that Manse is aligned properly, Mr. Fanning agrees. Mr. Fanning stated that if they want to repave now while we are sorting out this phase we can or we can wait until we hear back from the DA. Mr. Fanning would like to move forward with whatever the Board would like to do. He also stated that once he gets the review from the DA he will bring it back to the board. Mr. Fanning stated that there is no funding to buy out that right of way so until he gets legal opinion he cannot pursue the buyout path. Commissioner Schinhofen stated that maybe we should just ask the property owner to give it us.

Mr. Fanning

stated that he could do that.

Mr. McRae

made a motion to follow the path for acquiring the right of way on Homestead from Manse to Gamebird by writing a letter to the property owner requesting they give us the right of way so that we may proceed with the project.

Mr. Fanning

stated that there is no funding for this project so it cannot go out for appraisal. Mr. McRae stated that until we hear back from the DA someone would have to motion for allocation of funding. Mr. Fanning stated that is correct.

Commissioner Carbone

seconds the motion. Mr. Fanning has additional discussion, that property has no right of way around all four areas. Commissioner Borasky asked that the road be straightened out at Manse and Homestead. Mr. Fanning stated that it is this way on Jean, Oakridge and Manse plus this piece needs all four areas for the right of way. Manse is a major carrier and collector and so is Homestead, we are having conflicts in this area. Mr. Fanning will pursue these areas and other as well and will generate a cost off the assessor’s page to use.

Commissioner Schinhofen

stated that Homestead and Manse are the priority. Mr. Fanning stated that he needs Jean and Oakridge for the drainage. Mr. McRae thinks that we need to give a definitive direction to the staff so that we can move forward with this project. Commissioner Carbone asked Mr. Fanning if he needed any other direction other than to go out and ask those property owners for the right of way.

stated no. Commissioner Schinhofen asked Mr. Fanning how that needs to happen, do we ask for the right of way or can Dave go ask for the right of way.

Mr. Fanning

stated that he can ask. Mr. Fanning stated that he needs to follow the District Attorney’s direction of consistency from the past.

motioned for the next meeting to be on April 15, 2014 @ 8:30 a.m. Mr. Cameron McRae seconds. Approved 3-0.

Commissioner Schinhofen

wants to go over the 2014/2015 RTC budget. Mr. McRae would like scheduling updates for Manse and Calvada. Mr. Fanning stated that he will have the costs for Homestead right of ways also.
