called the meeting to order at 8:30 a.m.

Commissioner Carbone

would like to talk about the RTC expenditures and funds at the next meeting.

Mr. Cameron

McRae motioned to approve the minutes. Commissioner Carbone second. Approved 3-0.

Mr. McRae

stated that he had questions and concerns regarding this item during his travels throughout the county. He contacted the Public Works Director and asked him to present some options. Mr. Fanning stated that a PCI index was done in this area and it shows that the first mile is a 50 PCI which is fair and every ½ mile after that is failing, meaning they have alligator cracking or severely cracking. A Chipseal was asked to be looked at to see if it was feasible. Mr. Fanning asked staff to pull some samples from the Round Mountain Gravel Pit where we have a stockpile of chip. He also stated that he will send it off to Las Vegas and have it tested.

Mr. Fanning

stated that he will put a project together at the county’s expense rather than putting it out to bid. He will put a test section together and that will buy that Regional Transportation Commission – Minutes July 15, 2014 road about 5 years once it is crack sealed. Mr. McRae asked if it was the first ½ mile off of Hadly or the Highway. Mr. Fanning stated that it was off Highway 376. Mr. Fanning also stated that it usually takes about 2 months for a rough test and 6 months for a positive/negative test which is where they test to see of the oil will stick to the rock. He will do a stripping test with it as well. When all of the testing is done he will crack seal that road. Mr. Fanning stated that crack sealing is best done in the winter when the cracks are the widest. Commissioner Schinhofen asked if the rating system was part of the Master Plan. Mr. Fanning stated yes it is it is also in the Lumos study. Mr. Fanning stated that we have inherited the PCI rating index so that we know the conditions of our roads. This is done by Tim Carlo in the south end of the county and by Doug “Stretch” Baker in the north end of the county.

asked that we take a look at the updated Master Plan before the end of year. Commissioner Carbone asked if this was because of the school bus. Mr. McRae stated no, it’s the only road into the subdivision. Mr. McRae also stated that Round Mountain maintains their roads within the town but this particular subdivision is county maintained. Commissioner Schinhofen asked Mr. Fanning if there are funds to do this once the testing comes back. Mr. Fanning stated yes. Mr. McRae stated that if it is going to be done by Public Works then he is ok with that and it is no longer an RTC issue.

asked for discussion on this topic to see what can be done to finish up where the chipseal stopped off of Hafen Ranch where it splits into the Indian Reservation and Turner. Commissioner Schinhofen would like to see what can be done to that area where the school bus turns around. Mr. Fanning stated that due to the time frame we had to get the chipseal completed which was before the end of our fiscal year. He also stated that we found that the roads right-of-way is on personal property. Mr. Fanning then turned the floor over to Tim Carlo. Mr. McRae asked if we corrected this issue back in the 90’s when the Board of County Commissioners took action to address all the alignment issues between the roadways and properties. Mr. Carlo stated yes but in the 1990’s when it was realigned you can find 2 different maps for this area. One shows the road in its private property state being the proper right-of-way when it was taken care of everything shifted east and south. That area on Superior and Hafen moved 40’ to the east. In order to move that back into the right-of-way we would have to move a power pole into the native BLM land. Mr. Carlo also stated that the power pole is right in the middle of that area. Commissioner Schinhofen asked what we can do now to get the chipseal going through to the village so the school bus doesn’t have to turn around on gravel. Commissioner Schinhofen also asked if there were any funds available to make this happen and to get the right-of-ways. Mr. Fanning stated that the 3 power poles are going to cost about $5,000.00 each to have moved out of the right-of-way and the same with the AT&T line. Commissioner Schinhofen asked if any of this cost would be borne by the utilities. Mr. Fanning stated that 2 Regional Transportation Commission – Minutes July 15, 2014 some of it is and some of it isn’t. It depends on how they want to work with you and what it is they want to achieve. Mr. Fanning stated that AT&T has been very cooperative in the past. He also stated that VEA would not, there would be a cost.

stated that they stopped the chipseal at a safe place. Mr. Fanning pointed out that if you took Superior Lane all the way down there wouldn’t be enough 100’ right-of-way at the end to place a cul-de-sac. Commissioner Schinhofen stated that we would need to acquire that right-of-way. Mr. Fanning stated that is correct. We would need to gain right-of-way between lots 15 and 16 for a cul-de-sac so the bus can actually turn around without having to use Superior Lane which would cause the chipseal to be torn up. Commissioner Schinhofen stated that he wants Mr. Fanning to move forward with this and find out the costs involved.

also stated that he would like to ask for the right-of-ways but if not then that will be an added cost. Mr. Fanning stated that it was going to take some time. Commissioner Schinhofen stated that he thought it would be a good idea for the school bus. Mr. McRae stated that doing a 3 point turn is something they try to avoid but due to the specifics of this area it is something that they need to improve.

asked if anyone had any comments about the Policy and Procedures Manual. Mr. Fanning stated that he thought this was what

was talking about when he mentioned the Master Plan.

stated no. Commissioner Schinhofen referred to the Policy and Procedures Manual where it states that every two years we will review the Master Plan. He also stated that this was something that Mr. Fanning stated he could do in-house. Commissioner Schinhofen would like to see this at least updated at the next meeting. His future hopes are that we can work with PRPD Master Plan and the CIP Committee Master Plan can work together. He also stated that by having this Master Plan updated we will be able to see what major roads were added, what areas need to improve and what is going to connect what. Mr. McRae made a motion to approve the Manual as submitted, Commissioner Carbone second. Motion Approved 3-0

stated that he asked for this discussion also.

thought that the section behind the first two lots, first one on the right second one on the left as you are driving in, were county maintained and that we had right-of-way. Mr. Fanning stated that he doesn’t recall 3 Regional Transportation Commission – Minutes July 15, 2014 all of that. He does recall that the immediate problem was taken care of by the homeowners where they dropped some gravel. He also stated that Commissioner Schinhofen is correct by saying that if you go east off of Quarterhorse down Mary Lou the first lot has no right-of-way, adjacent to that has a 30’ right-of-way. It then butts into the two properties on the left going east bound and next to that is the one without right-of-way. Mr. Fanning believes it is a mining claim or patented mining claim. That is something that does take awhile for the DA to review because they are Federal. Mr. Fanning thought that since the gravel had been taken care of that this was no longer an issue and he has not pursued it. Commissioner Schinhofen stated that he originally asked because he wanted it graveled and maintained. He thought the back half could be graveled. Commissioner Schinhofen would like to know what can be done for these 9-10 homes. Mr. Fanning stated that Mary Lou has never been a county road. It has never been dedicated or offered. The Planning Department has taken all the property to the east. Those first two properties without right-of-way are not accessible without trespassing. Mr. Fanning stated that he cannot get in there to do any maintaining without acquiring right-of-way. Mr. Fanning asked if he would like to make Mary Lou a county maintained road. Commissioner Schinhofen stated yes just that one section. He also stated that the home owners would like to have that road graveled. Mr. McRae stated that these 10 homes are basically landlocked with no public access from a Nye County maintained road. Mr. Fanning stated that is correct. Mr. McRae stated that we do have a road that can be validated as being there for at the past 30 years.

also asked Mr. Fanning if he was reluctant to travel that road to access existing county accepted roadways because of the right-of-way. Mr. Fanning stated yes, that is correct, to build it. Mr. Fanning stated that to get a piece of equipment in there would be an access issue. Mr. McCrae stated that there is a roadway in its primitive form. Mr. Fanning stated that he is reluctant because it’s not a public access. Mr. Fanning stated that Mary Lou has never been a dedicated road, ever and the homeowners put that area of road in. Mr. Fanning stated that planning laws in the NRS 278 allows access to lots and the back lots are dedicated and the lots to the east are also but we can get there. The reason we can’t get to the lots is because we are landlocked out of it. Mr. McRae stated that there is a right-of-way in there somewhere when the county created the parcel map with roadways in them.

stated that he cannot go in and maintain a private road. Mr. Fanning stated that we are not maintaining even that back half because there is no right-of- way. Mr. McRae stated that he misunderstood. Mr. Fanning stated that the lots in question have no right-of-way. This all started because a guy went out with his tractor and dug up the road causing a poof hole for the people to the east. The county was then asked to fix that hole on a non county dedicated right-of-way.

stated that he worked with a private entity to get that poof hole fixed but he would like for Mr. Fanning to see what can be done moving forward to get the right-of-way. Mr. Fanning stated ok. Commissioner Carbone stated that if he was going to start acquiring non county roads right-of-ways then we need to look at all areas of the county with that same issue. Commissioner Carbone 4 Regional Transportation Commission – Minutes July 15, 2014 stated that he has those issues in his district also and he doesn’t think we are going to be able to take care of all them. Commissioner Schinhofen stated to bring them forward and we will take a look at them. Mr. Tim Carlo stated that you will run into problems like it just being a record of survey. Commissioner Schinhofen stated that if we don’t start accepting some we will never accept any and each one needs to be looked at separately. He also stated that if it’s the will of the board then we will only gravel the back half of it.

asked staff to see when the next date would be. Mr. Fanning stated that if they wanted a quarterly meeting, the next date would be October 21, 2014. Commissioner Carbone motioned to set the date as October 21, 2014 at 8:30 am, Mr. McRae second. Approved 3-0.
