Commissioner Schinhofen

called the meeting to order at 8:30 from the Board of County Commissioners Chamber in Pahrump.

Commissioner Schinhofen

stated that Tim Carlo will provide a detailed account of this information in another item. Ron Pharris stated that he would like to see it go back to State Representatives in Carson City.

Commissioner Schinhofen

said it was his understanding we did get some funding for Secure Rural Schools so when we set up budget for next year he would like to see some of those funds go towards Gamebird/Barney. Commissioner Schinhofen asked Tim Carlo to go over the results of the traffic study they did on Gamebird. Tim Carlo stated he has not done Barney at this point but the total car count on West Gamebird west of Winchester is 1,192 cars and 87 trucks with an am average speed of 56.6 MPH and a pm average speed of 46.4 MPH for a 13 day period. Commissioner Schinhofen stated that seems like a substantial increase over there, since the road was improved but we don’t know for sure because we didn’t do a count before. How does that match up? Does it seem like a fairly busy road? Tim Carlo stated it seems busy for a gravel road.

Commissioner Carbone

asked for a copy of the counter reports but has no further comment at this time. Mr. Koenig has no comment at this time. Commissioner Schinhofen asked Mr. Fanning when we plan to get the budget for RTC for next year.

Mr. Fanning

stated he will be going through the budget process today. Once that is done I am sure the finance person will be getting a hold of our department and hopefully we can get it on the next agenda. Commissioner Schinhofen asked if it needs to be set the same as the Board by May. Mr. Fanning stated it does not need to be set at all. He stated he can just bring it to the RTC Board and then through that process. What you the RTC Board are going to do with your budget will be something we have to find out after the Board meeting. Commissioner Schinhofen asked if we are going to need a meeting in May or June. Mr. Fanning stated he recommends June for the meeting. Mr. Schinhofen asked if there are any further manager’s comments. Having none

Commissioner Carbone

asked how much more that gives us with the additional 5 cents per gallon. Commissioner Schinhofen stated $1.482 almost $1.5. Mr. Fanning stated that this is only based on the 4 cents. What we planned on doing is giving this to the RTC before we modified it and took it back to the Board. This is based on the actual 4 cent. The RTC can recommend increasing it to 9 cent so that would be an additional 2 on top of the 7. Commissioner Schinhofen stated that on this chart it’s from 4 cent to 7 cents. Going to 7 cents is almost $1.5 and that’s what this chart shows and if we did that it could give us an additional 6.18 miles. Mr. Koenig stated an additional 2.7. Mr. Schinhofen stated really 2.7 at $250,000 a mile? Mr. Fanning stated that yes that is the farthest column out and that is a brand new rebuild. That’s actually building it with the sub grade and putting in the asphalt on the surface. Commissioner Schinhofen stated so that’s a total rebuild, so if we pass it at the BoCC we could say that this 3 or 5 cents that we are increasing could be earmarked to old roads so that people know that we are not 3 building new roads but maintaining roads that we haven’t had the funds to maintain.

stated don’t we need something that says this is how many miles of road we can fix based on these increases? I have a problem with going to the public and saying you’re going to pay more on 2.69 miles. Mr. Koenig stated Commissioner Carbone and I talked about showing what we could do with this money. I don’t want to see new roads right now, that’s a different discussion. I’m talking about roads that are crumbling and falling apart and we need to fix them. We need to replace some entirely but we don’t have the money to do that. I need something in here to reflect Superpave whether we need more study or not. As far as I am concerned if California says Superpave is good we talked about using Superpave on Homestead, how does that relate to the $240,000 per mile cost? I need something to say to these guys this is how many miles of road that are going to be fixed. A lot of people have roads that are fine so that’s where the problem comes in. Those people don’t see why they have to pay more fuel tax. Someone that lives on a street that is full of potholes is going to want to increase it so their streets can be fixed. Commissioner Schinhofen stated, Mr. Koenig I think what you are looking for is how many miles of road if we rebuild them. I don’t think it’s going to be hard to say if the bases are good how many miles of Superpave we can do with the additional revenue. Commissioner Schinhofen asked Mr. Fanning if he could revise the presentation so that it shows for the old roads that do have a decent base what it will cost to repair them. Commissioner Carbone asked when Mr. Fanning would want to send this to the BoCC. Mr. Fanning said he would like to modify it before presenting it to the BoCC. Commissioner Schinhofen stated June to have that revised. In June we’re going to look at the Budget, if Mr. Fanning can get us those figures to look at to satisfy those question then we can move it on to the BoCC. Mr. Fanning asked to do it sooner than that. Commissioner Schinhofen says I’m fine to do it in May but that’s up to the Board. Mr. Fanning asked if May the 18th when the BoCC has to do their final budget.

stated that he would actually like to do a presentation to the Board. That way it’s before what the RTC does for your final budget and I can prepare it and present it at the June meeting. Commissioner Carbone stated if you’re going to do an early meeting in May it’s just going to be a presentation with no action. Mr. Fanning stated yes that is correct. Mr. Carbone stated if Mr. Fanning goes before the board just for a presentation he did not have a problem with that. Commissioner Schinhofen stated that I think he is trying to get it in before the budget for this year. Commissioner Carbone stated that’s why he says he wants to do it with the corrections on it in June.

stated but we set our budget in May. Mr. Koenig stated we can have a meeting in May. Commissioner Schinhofen agreed and said he will be in Georgia at that time but he can call in. Mr. Koenig stated it doesn’t have to be the same day as the BoCC meeting. We can have it another day. Commissioner Schinhofen stated that the BoCC may start at 9AM at their next meeting so that’s something we need to take into consideration when we do set our next meeting date. Commissioner Schinhofen asked if it was clear what the other Commissioners are asking for. Tim Carlo stated it is clear to him. Mr. Schinhofen asked if there is any public comment.

asked the public if they think these 3 to 4 cents a gallon are a good idea considering it has to go to projects. The max we can do is 5 cent. Albert Bass stated this is a lot of good information and good presentation by Tim Carlo. I was looking forward for the last couple months to see some of that. Dan brings up very valid 4 points and as I am looking at transportation in the future between public and private transportation and the road conditions there’s a lot of issues there especially with the growth and demographics we have coming. Points that the other two Commissioners made are very valid points but making the clarity and what the money is being used for will help with that. Commissioner Carbone stated I concur with that as long as the people can see where the money is going. Commissioner Carbone stated there may be a sunset clause in this as well. If we get more financing through the 12.12 we may be able to reduce that tax down again. Bill Clark stated that he thinks that the Board has an opportunity to raise some money that is really needed and the tax basis dropped so bad that everybody has a windfall but you. So this is a way to do it legally, and it shouldn’t hurt anybody. We really need it bad on all the roads.

asked him to get that word out there. People are really fighting bad not to have this. Commissioner Schinhofen stated that every time this issue comes up people right away are saying you are raising our taxes. People in elected positions don’t want to make those decisions, and I get that. We want to be fully convinced that it is the right thing to do. So we have been stalled for almost 30 years and we have roads failing because Boards didn’t want to make the call. Commissioner Carbone stated well again going back to what you did before is you put it on the ballet, and the ballet came back as a no. It’s really hard to go against the public that says they don’t want it. Mr. Koenig stated do we want to look at saying something like the money has to be spent on the materials but the money is only going to be spent where it is collected. This part of the county collected this amount of money so it’s going to be spent there. Can we lock it down like that? Mr. Fanning stated it is technically not. I do charge the towns per quarter for what gas taxes they actually bring in. We really only have 35 miles of paved road in Tonopah. It’s really hard to track and put a base price on it. Holding it down to what is collected the RTC manages the entire County so you will always have the jurisdiction to put it where you see fit, but we want to make sure we are receiving the revenue that we should be receiving. That is something that I have been working diligently on. I am getting close but still a grey area of actually the funding sources. Mr. Schinhofen wanted to clarify this does not have to do with the Town of Tonopah it has to do with the funding and how it is coming through the State. We will see about a date and time so we can get this moving forward. Mr. Koenig stated to Tim Carlo if he wants to discuss this with him to give him a call.

stated he noticed on the 2nd page where it talks about the names of the projects, budget and the remaining balance and then when you see complete. Does that mean those are the funds that are remaining and those are funds can be used for something else? The words next say Project complete but must be reimbursed by RTC. What does it mean that the project is complete but need to be reimbursed by RTC? On Project N13006 it says it was budgeted at $350,000.00 and next to it says complete so does that means we have used all the funds? Mr. Fanning said that’s correct. Mr. Carbone says above it says funds remaining. Mr. Fanning stated that 5 those funds are available for something else on that particular Project. Mr. Carbone asked about N13051 the Type II. It was budgeted for $562,500 and it is showing $506,000 left. He asked if those funds can go someplace else as well. Mr. Fanning stated that is correct. Mr. Koenig stated that is $1,000,000.00.

Mr. Fanning

stated that on the last Item Commissioner Schinhofen did not open it for Public Comment. Commissioner Schinhofen asked on what item. Mr. Fanning stated on the Gas Tax Item. Commissioner Schinhofen stated that the Open Meeting Law says you can have Public Comment either during each item or before the meeting begins and after all items have been heard but he did ask Public to come up and speak about the gas tax item. Commissioner Carbone said we need to clarify it and open and close it since we asked them to come up. Commissioner Schinhofen opened Public Comment on Item 4 and closed Public Comment on Item 4.

stated he does not like the format of the report.

Mr. Koenig

stated that this is his item. The letter basically asked Utah Transit Authority to donate four vehicles in good condition and they will keep them up there as long as they have to until we can get them insured and have a place to put them and figure out the maintenance. Mr. Koenig stated that Mr. Borasky and Mr. Koenig are looking into a place to put them and at the maintenance. Commissioner Carbone asked Mr. Keonig what was discussed about the maintenance. Mr. Koenig said they are looking at talking to the school district on where to keep the vehicles and the maintainance of them such as oil changes etc. All of this gets partially reimbursed. Bottom line there is no cost to the County or School District but we just need agreements with people that you can do this or that. Commissioner Carbone stated if he remembered correctly there is still a percentage that is not covered. It’s not a 100%. Commissioner Schinhofen stated that on this item particular this is not going to cost us anything it’s going to be donated to the RTC and we will move them forward if a project arises, is there a motion, Mr. Koenig made a motion to have the chairman of the RTC sign a letter to Utah requesting donation of the four vehicles.

seconded that motion but there is still more questions to be asked. Motion Passes 3-0. Albert Bass stated that just on the vehicle maintenance that is a 95% reimbursement. Mr. Bass stated that we can make numbers work to cover that 100%. Commissioner Schinhofen stated to Mr. Fanning that we are not going to be bringing these vehicles down here until we have a place to park them and everything. Mr. Fanning stated that it’s under light duty so that will be under the County Manager. Mr. Fanning stated that some of these things that need to be ironed out are pick up areas and drop offs. What are we looking at is this whole thing needs to come together and not be done in pieces. Mr. Schinhofen stated that 6 this is not a part of the agenda item to discuss, so we have an opportunity to get these buses and we’ve done that and move on.

stated that Mr. Fanning and I talked about this in the office the other day. We don’t have to redo the whole plan. Commissioner Schinhofen stated we would just like a page or two that updates a couple of key roads like Bell Vista and 5.6 miles of road that are falling apart. Mr. Carbone stated that’s what I thought we were doing anyways was looking at the key issues not getting a whole plan. Mr. Koenig has no comment. Mr. Schinhofen stated that this is supposed to be reviewed every two years so if we get it done we don’t have to review it for another two years. Commissioner Schinhofen stated this year, meaning by December 2015. Mr. Fanning stated that there is a lot that goes into analyzing this information. It is not just off the top of your head analysis. You have to consider the speeds of those roads, the actual ADT’s, the shoulder run offs. That all goes into this so we will be pushing for December. Mr. Schinhofen stated that’s fine. He stated that this was brought up over a year ago and if we have to re- engineer the whole thing than that’s what we will have to do, but it has to be reviewed and we have to have a plan in place according to state law.
