called the meeting to order at 8:30 a.m.

Commissioner Schinhofen

stated that he does have an announcement but he will address it when we get to the item of setting the meeting date and time. He also stated that we may want to consider moving the meetings to a different day or time so that they do not interfere with the Board of County Commissioners meetings.

Mr. Timothy

Sutton stated that he recommends that you read through the NRS, it is quite lengthy and he just touched on a few key items. Mr. Sutton also stated that he is working with the county comptroller to make sure the fund is being called by the correct name, its being put in the correct account, and he just wants to make sure it’s not being called the Regional Transportation Commission fund. It should be called the Regional Streets and Highways Fund, this is important because both the NRS and the Nye County Code specify what the name of the fund should be. This is the money that comes from the 4 cent fuel tax. Authorization from that tax comes from NRS 373.030 and that money is used to fund projects as described in NRS 373.028.

Mr. Sutton

stated that fuel tax is described in NRS 373.030 and can be bumped up to nine cents per gallon and the implementation is described in NCC 3.04.100. He also stated that fuel tax has been at four cents since 1981. Mr. Sutton stated that the fund 10207 funds cannot be used for any project without coming to this board first. Once this board approves it then it can go to the BoCC for decision. Commissioner Schinhofen clarified that if this board approves it then the BoCC does not have to approve it. Mr. Sutton stated correct.

stated that the fund 10208 is exclusively controlled by the RTC.

Commissioner Schinhofen

clarified that these funds do not need to go to the BoCC for approval. Commissioner Schinhofen stated that we collect ¼ cent and we could collect up to ½ cent. Mr. Sutton stated yes but it would need to be established by vote of the public.

Mr. Sutton

stated that there is a fund that he and the treasurer and comptroller are working on. It’s a Special Fuel Tax Fund and he is not sure where the money comes from. Mr. Fanning stated that it accumulates about $1,500.00 a year. Mr. Sutton stated that he will keep doing his research and keep us posted on his findings.

Commissioner Schinhofen

asked the board if there were any questions. Mr. Koenig stated no. Commissioner Carbone stated that he would like to understand why the Special Fuel Tax Fund is there, was it the BoCC or the RTC that did that. Mr. Sutton stated that he would look into that. Mr. Fanning stated that he would like to thank the Commissioners for having Mr. Sutton research this, it’s good clarification.

stated that Tim Sutton’s research clarified alot of things. He also stated that it would be good to find out about item “c”, the Special Fuel Tax Fund. Commissioner Schinhofen stated that he has had people say they should increase the ¼ cent tax and now he knows that it has to be voted on by the public and the 4 cent gas tax can be increased up to 9 cents without a public vote. Mr. Sutton stated that there are other taxes that can be voted on too once that ¼ cent passes. Commissioner Schinhofen asked Mr. Sutton to send him a list of those taxes. He also stated that he won’t be using them anytime soon but just so he has it available. . 2 Regional Transportation Commission – Minutes September 15, 2015

Mr. Tim

Carlo stated that this project was brought up some months ago and he has put together the price of oil and fog seal. The procurement of chip oil is the main driver of this project and it will be in the spring. We can start it in the winter by crack sealing and hauling the chips in that is already in the area. We can do the rest in the first two weeks of May. Mr. Carlo pointed out that the price he has in there for the LMCRS 2-H oil is today’s pricing and it could fluctuate come spring. He also stated that because of the remote area he was not able to lock them into the price.

asked where this would be funded from; Mr. Fanning stated that it is funded from 10205. Commissioner Carbone made a motion to approve the project. Mr. Koenig second. Motion approved. Passed 3-0

Mr. Fanning

stated that this is something that the Commissioners asked for at the last meeting. Mr. Fanning stated that he has attached the only civil engineered plans that were ever done for the fairgrounds back in 2006. The plans show the approach takes you all the way up to the highway and does not line up with South Wheeler Pass Road as he believes that was the discussion in the last meeting. Mr. Fanning would like direction from the board to move forward since these are the only plans and they do not line up. Mr. Fanning also stated that in the last meeting

Mr. Darrell

Lacy has mentioned that there would be NDOT road widening going on in that area. Mr. Fanning searched the web-site for the statewide program and did not find any projects for widening in that area. Mr. Fanning stated that if there were plans for widening then he would apply for an encroachment at that time. Mr. Fanning would like direction from the board at this time.

Commissioner Schinhofen

asked what it would take to get Fox done to at least the parking lot at this time. He understands that in the future we may have redesign this and get new engineered plans but no matter where you put this road we are going to have to go over some really bad terrain and flood areas. Commissioner Schinhofen thinks it would be best to tie in across Wheeler and then bend the road instead of making it straight. Mr. Fanning stated that he met with the engineer last week and they are trying to tie the draining in with the existing Road Improvement Plan from the Town of Pahrump. When he gets the plans back he will bring it to the board so that we can start paving Fox from Gamebird to the parking lot. Mr. Fanning stated that the outlining area toward the highway is so full of silt and clay and 15 to 20 foot hills that would have to be removed in order to get the road in and attached to the 160. There would be a lot of drainage costs and a lot of consideration we would have to look into for the Town. The plan that exists can be set aside and new plan can be conducted and we can bring in another route if need be. Mr. Fanning stated that he doesn’t want to scratch this plan; it is a good layout of how they want to see the fairgrounds eventually evolve. Commissioner Schinhofen stated that there is a new plan of development that went to the BLM 3 Regional Transportation Commission – Minutes September 15, 2015 because they are trying to get a revisionary on that property. He also stated that he wants Fox done and engineered to the parking lot. He expects a lot of people for New Years at the fireworks site. He doesn’t think it will be done that soon but it will be done for next year. As we move forward we will need to get a new plan of development and have an engineer show us how to get it to the highway.

stated that it doesn’t matter if it is straight through from Fox or it ties into Wheeler and bends around through the fairgrounds. Mr. Koenig stated that he sees no reason why it needs to go any further than Fox. He thinks there will be more issues if we try to tie into the 160 and be very expensive.

Commissioner Carbone

agrees that Fox would be best until we have something more going on at the fairgrounds. Commissioner Schinhofen stated that as far as the widening from Rainbow to the Calvada Eye goes he would like to get any alignment issues up on the burner to discuss. Once we get the revisionary back and we have more control over that land where the fairgrounds are then we go forward from there. Commissioner Carbone stated that maybe Wheeler Pass may not be the right place but it may be the right place depending on what kind of recreational use will be in that area. Commissioner Schinhofen asked Mr. Fanning when Fox would be paved. Mr. Fanning stated this winter. We are looking at the drainage costs which are around $80,000.00 for the bridge section. We are trying to cut down on the concrete costs for the bridge that comes over the top. By cutting that down it cuts the costs in about half of what they are proposing. We are still going to engineer it; it will just be engineered in a different fashion. It will still retain its value with the dollars that are put into it we are trying to be smarter by not spending as much as they had originally anticipated. Mr. Fanning stated that he is looking at starting in November and the Homestead Project will be starting at the same time.

stated that he wanted it done by New Years. Mr. Fanning stated that he is pushing for it but it may not happen. Commissioner Carbone asked

if they could test the material that was passed on to him in that area.

Mr. Fanning

stated that he would not like to use it on that area; he would like to use it on Yucca Springs because there is farm equipment use in that area. He also stated that he spoke with Cameron McRae about a month ago and all the bus routes are now on chip seal and asphalt so Yucca Springs is the best area to test it. Mr. Koenig stated that he doesn’t want the entrance to the fairgrounds unusable for New Years.

Mr. Fanning

stated that it will be passable. The bridge sections will be a detour route coming up off of the east area road and come around to get then in there; it will be on a gravel section that is watered and maintained. It will be a gravel road like it is now. He also stated that there are numerous secondary routes and we will get people in there.

Mr. Koenig

stated that we need to pick a different date or time to the RTC Meeting because there is a problem getting Granicus running again after we meet for the BoCC meetings. Mr. Koenig stated that he would prefer a 10:00 a.m. start time on a different day. Mr. Fanning asked if this was for October. Commissioner Schinhofen stated that it would be for November and then we could get an update on where we are at with Homestead and the other projects. Mr. Koenig stated that it was fine but what he is looking for is in the future; we need to have a certain locked in time and day. Mr. Fanning stated that the end of October we may be back on 4 10’s so we would not be available on Fridays so any day that the board would like to do it we will be available. Commissioner Schinhofen threw some dates out. Mr. Koenig motioned for the meeting to be on the 18th of November at 10:00 a.m.
