led the Pledge. GENERAL PUBLIC COMMENT: There was no public comment at this time. COMMISSIONER/MEMBER COMMENTS:

Commissioner Schinhofen

delayed this item until after the budget has been discussed. *Commissioner Schinhofen stated for the record that he would like the public to know that the fund 10207 monies will go to projects and at the next meeting Mr. Fanning and Mr. Carlo will bring us a list of those projects that we will use the funds for. He also asked Mr. Fanning to bring back the Manse and Thousandaire project at the next meeting. Commissioner Schinhofen stated that he is excited for this upcoming year because we have some money to put towards a number of roads and in the next meeting we will see Pahrump, Amargosa, Hadley and Tonopah improvements. Pam Webster, Nye County Manager asked that we discuss the phone call that took place with the Tri-County Transportation Coordination. It will be ongoing and we have resurrected a group to share information between states. Commissioner Schinhofen stated that he will let Regional Transportation Commission – Minutes June 9, 2016

Mr. Fanning

and Commissioner Carbone talk with Cal Trans the Forestry at Death Valley and the Park Service in Inyo County. He also stated that they had a phone meeting and they all agreed to meet face to face once a year and at least half way through the year by phone so that we are all on the same page as to what projects are going on and also as we go for the grant to get Bell Vista rebuilt.

Commissioner Carbone

stated that it’s more so we sharing information as to what is being transported on our county roads. Mr. Fanning stated that Mike Reynolds, who is with Death Valley National Park, will write a letter of recommendation to support us with getting that Federal Grant. Mr. Fanning stated that he would like to get a letter from everyone who was at that meeting. Commissioner Schinhofen stated that since we are surrounded by Federal Lands that we should have pretty good chance of getting that grant.

Commissioner Carbone

stated that we have not stopped any of the busses that go through the area. Mr. Fanning stated that we have not and it was a request by the Park Service. *Commissioner Schinhofen stated that he wanted to continue this conversation under Commissioner/Managers Comments.

Mr. Fanning

stated that they are going to start both locations a half roundabout at a time. They have detours they are setting up. They will pave a section behind Pizza Hut so those business owners would not be impacted as much. Mr. Fanning stated they have all sat down and discussed the impacts. He also stated that Blagg Road will not be impacted too much but you will see it in the gas station and NDOT will try to do as much night work as possible, they will let us know.

Commissioner Schinhofen

stated that he would like to see the plans. Mr. Fanning will make sure he gets them. Mr. Fanning also stated that the roundabouts will be about 100+ feet. Mr. Lacy stated that it is his understanding that CIP is to allocate the funds; it’s not to get involved with the details and the implementation was for the RTC. Commissioner Carbone stated the CIP is allocating funds not managing this. He also stated that they need to go back and refer to the NRS.

Mr. Koenig

, who sits on the CIP Board, stated that the CIP Committee wants to see plans because they approve the funds and it should be started within a year and half from funding approval.

Mr. Fanning

stated that the contractors were to get back to the CIP with permits and plans and tell us when they were going to start.

Mr. Lacy

stated that the only project they talked about in the paper was the 160 and that is the meeting that is taking place today. FOR POSSIBLE ACTION: Discussion, deliberation and possible decision regarding: the approval of the minutes from May 25th, 2016.

made a motion to approve the minutes and it was seconded by Commissioner Carbone. Minutes approved. 2 Regional Transportation Commission – Minutes June 9, 2016 FOR POSSIBLE ACTION: Discussion, deliberation and possible decision regarding: 2016/2017 RTC Budget

Mr. Fanning

stated that the 10208 ¼ cent fund is the same costs that we do every year for maintenance. Mr. Fanning ran through the outline. First one being the Gravel Road Maintenance and Cold Mix. He stated that the Regional Roads covers the entire Nye County. Second was Projects. Mr. Fanning stated that the number for Projects has grown this year. He also stated that we do a lot of pavement maintenance and this will be in front of the program that we are launching for the major pavement preservation program. This will be for crack seal repair, skin patch and items of that nature prior to permanent asphalt overlays. Mr. Fanning stated that the number for the 10208 Projects is $1,180,000.00. Commissioner Schinhofen asked if the BoCC is authorized to administer these funds as he understands from the DA the BoCC votes this to the RTC and after they vote it to us we have control over it. He also stated that once we approve it at this level it doesn’t have to go back. Mr. Fanning stated that is correct.

Mr. Fanning

stated that the purposed 10207 RTC Budget for 2016/2017 which is the new 9 cent gas tax is expected to see an increase. From January to June there was an average increase of $636,000.00 and it has been included in the totals for the 10207 budget. He stated that from July 1, 2016 to June 30, 2017 will be the bottom line number that is stated in the backup. Mr. Fanning also stated that we did not increase any internal program costs from A-F due to the fact that we are sustaining in these account areas. Gravel Road Maintenance was increased by $100,000.00 for Northern Nevada for all the blade patrol, in case we have the inflation of oil, fuel and rubber prices. Mr. Fanning stated that the Pavement Maintenance Projects, again RTC approval, is in there for certain projects that the board sees fit. Mr. Fanning stated he wasn’t sure if they wanted to do complete rebuilds or overlays or what but it is in the budget for the pavement preservation program. Mr. Fanning stated that he will present that program at the next RTC Meeting.

Mr. Koenig

clarified that we are up $636,000.00. Mr. Fanning stated that is correct, from right now to the end of June we will be up to that number. He also stated that we have only collected January through March at this time and we still have April, May and June to collect.

Mr. Koenig

stated that was his question, he estimated that we would be over a million with the new 9 cent increase in a year. Mr. Fanning stated the he is correct. Commissioner Schinhofen stated that it will be about $1,200,000.00. Mr. Fanning stated that he is correct. Commissioner Schinhofen stated that when we talk about projects we will be able to see a lot of stuff getting done.

clarified that Mr. Fanning will give the board a list of the projects.

Commissioner Carbone

motioned to approve the Budget as presented and Mr. Koenig seconds the motion. Budget Approved. *Mr. Fanning asked that the board either make it clear or take a vote that pertains to the 10208 fund approval. To make clear that the board directs this to the BoCC and the BoCC directs that it come back to the RTC.

Commissioner Carbone

stated that we don’t need a motion because it is part of the process.

Mr. Fanning

stated that if this is what the board wants then he is fine with that. Commissioner Schinhofen stated that he will get Dave the information from the DA on which funds are which. 3 Regional Transportation Commission – Minutes June 9, 2016 General Discussion: Meeting with Bob Adams regarding the OHV and speed limit requirements Tim Carlo stated that he met with Bob Adams on Monday. Mr. Carlo pulled some NRS’s and he included them in the backup. There is a separation on OHV decals. The large decal with the stars around it is for OHV’s to drive anywhere and must carry an insured rider and has to follow all of the traffic laws including speed limits and must have a single taillight illuminated. The other OHV decal is the one that allows you to drive up to 2 miles to a designated trailhead and it has many more regulations on it. You do not have to have an insured rider and this is what most people have. Mr. Carlo stated that the Town of Tonopah approved NRS 490.100 and in the middle of that NRS it states that a county can designate any portion of a State Highways and it will be permissible for the operation of Highway vehicles. Mr. Carlo stated that this not something we have done in Pahrump. We have not designated any State Highways.

Commissioner Carbone

stated that at the time they were waiting for the Town of Pahrump to come back with something to look at and it never happened. Mr. Carlo stated that it needs to happen, the reason being is that Highway 372 and Charleston Park is not a good route because both sides are beat in with OHV’s and dust flies everywhere. Mr. Carlo also stated that without the designation of roads the OHV’s are just driving down the sides. Commissioner Schinhofen stated that they do the same thing on Homestead Road particularly past Thousandaire.

Mr. Carlo

stated that paragraph 3 in NRS 490.100 it states that City or County may adopt an ordinance requiring a person who is less than 16 years of age to operate under the supervision of an adult and that never happened in Pahrump either. Commissioner Carbone stated that we did that in Tonopah and required a helmet too. Mr. Carlo stated that a helmet is required on all OHV users; it is part of the NRS.

Commissioner Carbone

stated that he was hoping to take what we did in Tonopah and adopt them for the ordinance here in the Town of Pahrump and any other town so that we could do it as a county. Mr. Carlo stated this is what needs to be put together. When you start looking at this each town is independent and operates a little differently.

Commissioner Schinhofen

stated that he has heard from his constituents that people are riding their ATV’s up to Walmart and if they have the large decal with the star then it is permissible.

Commissioner Schinhofen

stated that we need to get the Sherriff aware or maybe we can adopt this in our ordinance so that they can be cited. Mr. Carlo stated that the county can designate, according to NRS 490.105, which prohibits the use of large OHV’s. We can designate where we want them to drive. This is where your signs come in that they are not allowed on certain roads. Mr. Carlo stated that as it stands now, all roads are designated for OHV use.

Commissioner Schinhofen

asked who was working on this project. Mr. Carlo stated that it was the Public Works Staff and Bob Adams has been included also. Commissioner Schinhofen asked Tim Carlo if he would bring something to board for them adopt or if we want to designate certain roads. Mr. Fanning stated Commissioner Carbone had it right, that they had planned on using the Town of Tonopah as an example and bring it forward. He also stated that the NRS has some changes in it from then to now. The trailheads still need to have signage. There are a lot of things that need to still happen as per the NRS. Mr. Fanning stated that just because it’s a 4 Regional Transportation Commission – Minutes June 9, 2016 road doesn’t mean it’s a trail. Mr. Fanning stated that we do not have things ready to roll it out here at this meeting; he just wanted to discuss it. Commissioner Schinhofen stated that we will see it at a future meeting. Commissioner Carbone

stated that he wished this would have happened when they did Tonopah. We could have implemented something for Pahrump but hopefully now we can get something done pretty quickly. When you look at all the people that are driving the OHV’s now they are creating dust and driving through peoples properties and it’s not good. We need to get this done so that we can designate where they are driving and control some of that dust. Bob Adams stated that Mr. Carlo did a great job but one concern is that we need to have a clear consistent message to pout out to the riders and for the tourism point-of-view. Mr. Adams stated that we can have routes that extend beyond the 2 miles. Looking at Carpenter Canyon to the cattle guard, a lot of that is private parcels with special plan development and if this ever happens we want to have some sort of a route so that citizens of Pahrump could get up to the mountain. FOR POSSIBLE ACTION: Discussion, deliberation and possible decision regarding: Alternative method of repair on Pahrump Valley Boulevard

Commissioner Schinhofen

asked if this item was going to roll into the next meeting when we talk about projects. Mr. Carlo stated, yes it is.

Mr. Carlo

also stated that this is a follow-up from the last meeting when we were asked to look at Pahrump Valley for repairs. We went out to see what we could do from Big O Tires to Calvada and ties in to the Superpave intersection that we had done and it also plays into the roundabouts that are coming. Mr. Carlo sated that the roundabouts are going to extend through the area in front of Big O. When we went out to look at it there is an area from Big O Tires down to the Bourbon area that will need some base work with a full depth grind and as you progress down there are several low water crossings that we want to extend by adding bike lanes. Commissioner Carbone asked if we had the easements in that area. Mr. Carlo stated in that section, we do. He also stated that by widening it and including bike lanes we will tie in the downtown park area through Dandelion, Calvada, the park the sidewalk and there will be bicycle lanes throughout that area.

Commissioner Schinhofen

stated that once we get all of this done he believes we will start seeing more bikes out there than what is there now. Mr. Carlo stated that he looked at the most cost effective way to do it and by widening the shoulder and extending it out a little bit and doing the sub base where we need to we can add 2 inches of base course there and 1 ½ inches of Superpave over the entire thing to widen it out.

Mr. Koenig

asked if this would fix the leak by the park. Mr. Carlo stated yes. We will go out 150 feet in both directions on Pahrump Valley and tie back in to Honeysuckle, Arrow, Bourbon and Mt. Charleston to make them flow better.

Commissioner Schinhofen

stated that we will vote on this in the July Meeting. Commissioner Carbone stated that he would like to have the media here for that meeting. Commissioner Schinhofen stated that he doesn’t have an issue with that. He would like for the public to know what we are doing. 5 Regional Transportation Commission – Minutes June 9, 2016 General Discussion: Update on Gamebird from Winchester to Barney and Barney from Gamebird to HWY 372

Mr. Carlo

stated that he is hoping to have the crews back out there by the end of the month. It is all depending on Bob Ruud Memorial Highway. It is scheduled for paving on June 20th. Mr. Carlo also stated that they have most of the sub base done on Gamebird. They will have to move it over and start on Barney.

Commissioner Schinhofen

asked if it would be done by winter. Mr. Carlo stated that it is doable. *Mr. Fanning had a comment about Item 5 and asked if we could revisit it. GENERAL PUBLIC COMMENT:

Mr. Lacy

stated that he was a bit confused by some of the discussion about OHV’s so he did some quick looking and found that we fixed the OHV ordinance in 2014 and this board designated every road in the county as open to OHV’s unless otherwise designated, which is what Tonopah did. He also stated that in Tonopah every dirt and paved road except for State Highways or other designated roads can be used by OHV’s according to Ordinance 481 which passed in 2014. Commissioner Schinhofen asked Tim Carlo to bring it back and clarify that this was for the use of the bigger decal on the plate. Mr. Carlo stated that by ordinance we have to designate our county roads and we adopted NRS 490. Mr. Fanning stated that each town has to adopt those. Mr. Lacy stated, no. Mr. Fanning stated, yes. Mr. Carlo stated that there are two different levels of registering an OHV as per the NRS.

Commissioner Schinhofen

stated to just bring back all the info so we can discuss it.

Mr. Lacy

stated that it isn’t necessary because the whole purpose of Ordinance 481 that was passed in 2014 was to open up every road that was unpaved. Mr. Carlo and Commissioner Carbone stated that we have not designated to cross the Highway and that is a must.

Mr. Fanning

stated that Tonopah adopted 9 crossings and it has to go through NDOT for their approval.

Commissioner Schinhofen

asked if they have to have that bigger decal to go to Walmart. Mr. Carlo stated yes. They must carry an insured rider sticker which is the bigger star sticker. Mr. Carlo sated that in the NRS if you have the other type of sticker in order to travel the two miles to a designated trailhead with the exception of fueling up and buying drinks and what not. Mr. Lacy stated that by accepting Ordinance 481 in 2014 you designated every road in the county for OHV use. Commissioner Carbone stated that it still isn’t legal to drive them without that star sticker.

asked if there as a Public Hearing with NDOT today regarding the construction on 160.

stated that it is at 4:00 at the Library.

also stated that he received the drawings for the roundabouts and would like to know how and who would like to go about meeting on this topic. Commissioner Schinhofen asked

what he thought. Mr. Fanning stated that this is a CIP Committee project and he thinks it should remain there. Mr. Fanning stated that the CIP has discussed this but not too much as they did not have the plans that Darrell is talking about. However, the money was 6 Regional Transportation Commission – Minutes June 9, 2016 allocated at that point in time. Mr. Fanning stated this project will take 1 year to complete and it will disturb the traffic, fire safety and the businesses in that area. *Commissioner Schinhofen closed Public Comment and opened up item 3 again.
