called the meeting to order at 9:00 a.m. PLEDGE OF ALLEGIANCE GENERAL PUBLIC COMMENT: COMMISSIONER/MEMBER COMMENTS: Tim Dahl stated that he would like to put SB48 on hold for now while he continues to compile more information.

motioned to keep the Board as is with Leo Blundo as Chair, John Koenig as Vice Chair and Tim Carlo as Member at Large. Tim Carlo second. Motion Approved. FOR POSSIBLE ACTION DISCUSSION AND DELIBERATION- regarding the Chipseal Program.

Mr. Dahl

stated that we have complied chipseal petitions from 2016, 2017 and 2018. He would like to get the word back out to the public that they can submit chipseal petitions whether it be through social media or our website. He will also announce it at the BOCC Meeting coming up. Regional Transportation Commission – Minutes February 10, 2020 Once that has been done Public Works will go through the petitions and bring recommendations to this Board for consideration. Mr. Dahl would also like to start having workshops to entice more input from the public. We will then come up with at final list and get it approved so that we can move forward with the chipseal program. Mr. Dahl added that we have PCI that needs to be taken into consideration as well as the petitions and the school bus routes for the chipseal and would like that to part of the selection of roads as well.

asked if there was a PCI on a dirt road. Tim Dahl stated no.

Mr. Dahl

stated that we did a program like this last year in the Belmont/Round Mountain area and considering that the equipment had sat for so many years he was a little nervous, but it worked out great. Having a full fledged chipseal program with 20 miles of road to chip in a season still makes him nervous but he is willing to dive in and get all those bugs worked out.

Commissioner Koenig

is concerned about the roads that are not accepted by the county and are we willing to open that flood gate. Mr. Dahl stated that Commissioner Koenig is referring to Crystal Aire Estates and those roads were never dedicated to the county. There was only one road dedicated and accepted by the county in the late 70’s. Commissioner Koenig stated that there are other roads that he is referring to. Mr. Dahl stated that it is the pleasure of the Board of County Commissioners to accept those roads. Commissioner Koenig thinks we need to do some of these roads. Mr. Dahl stated that this has been a discussion for many years from what the developer’s intent was or whether they had the signatures from the BOCC or a record of survey. Back in the 70’s we used that as a mechanism to dedicate and accept road right-of-way.

stated that today that would not be an official way to dedicate and accept ROW’s. We no longer use a record of survey for those purposes. Mr. Dahl stated that this same subject has been brought up with the DA’s office many times in his time at the County with no teeth to bite on.

stated that he has been told over the years that there is a General Improvement District that people use as a mechanism to get 66 2/3 % of the people in the neighborhood to agree to dedicate that property fronting their house to the county then the county either accepts or not. If the county accepts it then the residents can ask that the county improve that area with the costs being out on their taxes over the next several years. Mr. Dahl stated that there have been a lot of things like this over the years but no real mechanism to accept what was once rejected. Mr. Dahl stated that its very simple for the Board to have a resolution in place to accept those roads that were dedicated but rejected.

stated that this one of the first things we look at when deciding the chipseal roads.

also stated that right now we are looking at Cabo and Quail Run because both roads were dedicated and rejected and its up to the Board to accept those. Once they are accepted, we can make decisions on what best for that area.

Mr. Carlo

stated that we need chipseal maintenance on some of these roads that have been chipsealed in the past and that a lot of the petitions that Mr. Dahl has in his possession are because the roads are not dedicated or accepted.

stated that we need an agenda item to discuss this. Commissioner Blundo would like to see what the cost would be to redo some of these roads in chipseal form and how much money are we dedicating to this program in year 1. 2 Regional Transportation Commission – Minutes February 10, 2020

Mr. Carlo

stated that the local municipality can take ROW if need be. Mr. Carlo stated that it is not a simple task to get the people who live on those roads to know that we need the ROW in order to maintain those areas.

Commissioner Koenig

stated that it is time to address these issues. He wants to know the cost to repair a chipseal road or redo a chipseal road and or the cost to put in a new chipseal road. He would also like to discuss the ROW issues within the Crystal Aire Estates, Pahrump Valley Estates and various others that need addressing. FOR POSSIBLE ACTION DISCUSSION AND DELIBERATION-regarding the updated Lumos Study. Tim Dahl stated that the Lumos Study states what it has always stated and that is that our roads are deteriorating, and we will never be able to keep up unless we spend millions and millions of dollars on them. Mr. Dahl stated that it is important to create plans that include chipseal, micro surfacing, slurry, reconstruction or pavement maintenance so that we can get our roads in better shape than what they are currently in.
