Mr. Carlo

had nothing. Commissioner Koenig Thanked Tim Carlo for his service on the Board as this will be his last meeting as Member at Large. Commissioner Blundo echoed Commissioner Koenig.

Mr. Dahl

also thanked Mr. Carlo for his service and he also introduced our new Public Works Assistant Director, Tom Bolling. FOR POSSIBLE ACTION DISCUSSION AND DELIBERATION- Discussion and Deliberation to support and approve including Linda St. from W. Mazzuka Ave. to W. Roadrunner Rd. consisting of approximately 5,276 feet on the Approved 2020 Chipseal list.

Mr. Dahl

wanted to apologize for not doing more research on this road prior to our last meeting when he agreed to put it on our Chipseal List. After further investigation into the ownership of the road he found that approximately 1600 feet of Linda St. from Roadrunner going to the north is owned by three different private property owners and then when it gets to Mr. Kulkin’s property which he has dedicated to the County and on up to Mazzuka. The west side of the road is all owned by BLM. Tim stated that it his fault for not bringing it to the attention of this Board and the Board of County Commissioners sooner. Tim stated that he has some additional back up if they would like to look at it. It is an overhead aerial view of the areas that are dedicated and those that are not and the challenges we face not have the ROW in that area. stated that there are other roads like Cabo, Blosser and Quail Run that were approved for the Chipseal that are on the list too and we should not be singling out roads.

stated that when they did his road, Sloan, it was dedicated on his side but not the other side and since no one really cared they put the road right up on his property line.

Commissioner Koenig

was confused on why we were pulling Linda off the list when it’s the same scenario and this Board voted 3-0 to have Linda added at the last meeting on July 1st.

Mr. Dahl

addressed his question regarding the ROW on Cabo, Blosser and Quail Run. When that came up on this Board and then went to the BoCC, the BoCC did approve to accept those roads that were once rejected so that we could put them on the Chipseal List. Mr. Dahl cannot answer for his predecessors on what roads got Chipsealed in the past. Mr. Dahl wants to make sure that while he is the Director that he does not create any liabilities for this Board of the BoCC or himself personally. Mr. Dahl would like the opportunity to obtain ROW and not leave it off the list entirely, although he believes the cost of doing this road far exceeds what we should be spending for one person that is complaining.

Commissioner Koenig

stated that if you look at the GIS for Cabo, Quail Run and Blosser there are no red lines. Mr. Dahl stated that the GIS is not 100% accurate and there will be a significant amount spent on those that have never been built yet. There is one low water crossing up there and there are nine on Linda that we counted and that’s not all of them. Mr. Dahl stated that we are talking 80,000.00 for less than a mile of road, we have already spent 30,000.00 doing Road Runner from 160 to Linda, so essentially, we are talking over 100,000.00 for one individual.

Commissioner Blundo

stated for the record that there are about 17 homes out in that area, so this is not for just one individual. Every taxpayer in Nye County deserves to have a good road.

Mr. Dahl

stated that this Board and the BoCC approved the list and he is going to do it. He is just asking for more time to get the ROW’s accepted and an offer of dedication so that it is solidified before doing work on the road.

Commissioner Koenig

stated again that Linda was on the list and it was approved by this Board, 3-0 and when it came before the BoCC is was no longer on the list.

Mr. Dahl

stated that since we don’t have ROW it can only be contingently on that list until we have those ROW’s. Mr. Dahl stated that he brought it to the Boards attention at the first opportunity which was at the BoCC and it was not a list he had to take before the BoCC because it was approved to use RTC Funds and does not need BoCC Approval. Tim stated that he chose to bring it before the BoCC so that this Board would not be surprised when they saw contracts come across their desks. Commissioner Blundo stated that he believes it should have stayed on the list and remained number 21 as discussed in the RTC Meeting with the understanding that there is a lot more work to do. He also wanted to bring forth another area which was Cabo and Quail Run but that came us as its own item. The reason that Blundo asked for this to be its own item today was to allow the opportunity to address the concerns for Right-of- Way.

Commissioner Blundo

stated that from this point forward he would like to get this done. Tim Carlo stated that we put gravel on that road years ago and we have maintained it since. He also stated that there are more than people that use that road than the one squeaky wheel. Tim Carlo stated that it should stay on the list contingent on obtaining the 1600’ ROW or getting BLM permission or pushing it off for a year until there is more money. 2 Regional Transportation Commission – Minutes August 13, 2020

added that if it’s the cost then maybe we should make a special consent. Tim Carlo stated that the Road Department has graveled and maintained that road for as long as he can remember.

Mr. Dahl

stated that he has gone out there and spoke with the constituent and has made sure that Emergency Service vehicles can get out there. He also stated that there are other constituents that live out there that are just fine with the gravel and do not want the road improved.

Commissioner Koenig

motioned to approve Linda St. from W. Mazzuka Ave. to W. Roadrunner Rd. consisting of approximately 5,276 feet on the Approved 2020 Chipseal list with the exception that the road will not be chipsealed until we have the proper dedication of Right-of- Way. Tim Carlo, second. Mr. Dahl stated that if passed, he will be happy to get started on obtaining the Right-of Way. Commissioner Blundo stated that for the record the District Attorney’s office does support that we follow the requirements of the law. Motion Approved. 3-0.
