motion to approve the minutes, Blundo second. Approved. Regional Transportation Commission – Minutes January 20, 2022 FOR POSSIBLE ACTION DISCUSSION AND DELIBERATION REGARDING THE ROUND MOUNTAIN FUEL TAX COLLECTED AND THE MAINTENANCE OF ROADS TO BE MAINTAINED BY NYE COUNTY PUBLIC WORKS ROAD DEPARTMENT.

Mr. Bolling

stated that Round Mountain created a resolution to give the County back control of the gas tax that they have been collecting since 1995. Mr. Bolling stated that we are trying to decide if it’s a good idea to do that because along with it comes the maintenance of roads in that area. The streets in Round Mountain are in disrepair.

Commissioner Blundo

asked if we will be responsible for all the roads in the Town. Mr. Bolling stated yes, and we already maintain the roads in Hadley. None of the roads have been being maintained. Blundo asked if that was part of what they were supposed to do. Mr. Bolling stated yes. Mr. Bolling went over the funding spreadsheet that he received from Savannah Rucker, Nye County Comptroller. The fund balance started out at $124,505.00 in 2003 and has an ending balance of $616,286.00 in 2022. The revenues and expenditures have varied over the years. Mr. Bolling stated that they haven’t spent money on maintaining the roads. Mr. Bolling stated that Finance pulled items purchased that were over $10,000.00. They purchased vehicles and equipment that can be utilized by the Road Department. Mr. Bolling stated that we should ask for these assets as well if we decide to accept the resolution.

Commissioner Blundo

asked why the CCTV Cleaning of sewer lines was on the expenditure report because it is not an asset. Me Bolling stated that it was over 10K and came from road funds, but it should have come from utility funds.

Mr. Dahl

stated that he spoke with Pearl and Melda from the Town a while back and he told her that if they were to take over the roads, one of the first things they would do is to camera the infrastructure. This is so that we would have a better understanding of what kind of shape the roads are in. Tim stated that the report from that shows many areas that deteriorated, at least a dozen or more but the funds to pay for this should have come from utilities not roads. Savannah Rucker pulled the invoice from Eden and stated that the total on that was in fact $77,000.00. They paid $42,000 from their utility fund and $35,000.00 from the road fund. Savannah stated that it was the decision of that Town’s Board to break it down that way.

Mr. Koenig

asked if that 77K was possibly used to repair any roads. Savannah stated no, it was for camera work underground and cleaning of pipes.

Mr. Bolling

stated that there are 13.31 miles of asphalt and 12.53 miles of gravel that we would be maintaining should we accept this resolution. The cost repair is estimated outside of Hadley is at $9,988,765.27. The cost repair inside of Hadley is $2,102,805.15, both of these estimates include contingency.

Mr. Dahl

stated that the original 1995 resolution had no definition of the areas in which the funds would go to and that is why there is taxing district map on the new interlocal agreement. Tim was hoping to get that adopted by the BoCC last month when it was on the agenda.

Mr. Jabbour

stated that the Town of Round Mountain will have to agree with the boundaries because the definition in the resolution reads Round Mountain-Hadley and that is not a clear definition of the boundaries. We need to get together with them and resolve that. Mr. Dahl stated that we have given them the new agreement including the map. Mr. Jabbour asked if they approved the map. Mr. Koenig

stated that he has two issues with this agreement. The first thing is that this agreement gives the Town the option to bow out anytime they want to, and we don’t allow that with anyone else. Typically, we end up spending more than we receive in taxes and the reason we are a County is so that we can spread the wealth among the entire population within the County. The second issue is the cost. If we look at what we receive in gas tax, it’s going to take 25 years to amortize that. He agrees that we should be helping them, but he would like to know where the money has gone to over the years. We need to figure out how to afford taking on the maintenance for the roads in Round Mountain.

Commissioner Blundo

stated that as a County we have to help. If you do the math, the Town will have to bring in $480,000 a year in gas tax for us to maintain those roads. As of now they only bring in $81,000.00, roughly.

Commissioner Jabbour

stated that we are obligated to help the Town of Round Mountain as they are part of Nye County. Mr. Koenig stated that we are morally obligated but not financially. Jabbour stated that we need to figure out the numbers and get clarification and bring it back before the Board of County Commissioners. We also need to inform the Town that if we decide to enter into this agreement that the work is not going to happen as quickly as they’d like. They will be put on the priority list like every other road in the county.

Commissioner Blundo

stated that the last time he was in Round Mountain he thought the roads were pretty good. He also stated that there is going to be an issue with the costs and mobility to get equipment up there. If we go up there to do 1 mile of road we might as well do 3 since the equipment is already there. We will still prioritize the roads that need to be done on the Priority List. Commissioner Blundo stated that financially, this will never pencil out, but they do bring in a revenue source. Mr. Blundo asked if the Town was able to help us in regard to equipment and assets that are currently in the Town of Round Mountain.

Mr. Bolling

stated that the Town has equipment up there that we are able to use if needed. We also have employees that live in the area. We would leave the equipment that is there in the area to utilize when needed if we enter into the agreement and take on the assets.

Mr. Dahl

stated that we have always had a grader at the top of Pablo Canyon, and we leave it there so that it is available to use in emergencies. We have also helped the Town over the years with various little things like the cattle guards, or potholes that they didn’t have material for. The have compensated us for these things and we are all working together to keep the community safe. Mr. Dahl stated that the roads in Hadley belong to the County, they are dedicated and accepted but they collect the funds to maintain them. Savannah Rucker stated that she had her team reach out to Pearl from the Town and ask for the town audits dating back to 1996 when the fuel tax first began. Ms. Rucker does not have those reports yet but when she gets them, she will update the financial sheet and send them to this Board in an email. Everything we have in our system dates back to 2003 and anything beyond that we would have to research the paper archives. She’s hoping the ink hasn’t dried up on the paper copies but at this point she’s looking for totals dating back to 1996. Ms. Rucker sent a report showing how the Town has spent funds dating back to 1993 and she sent the information to Public Works, but it is public information also. Since 2003 to current, they have spent 70,000.00 on fuel, 151,000.00 on vehicle maintenance, 212,000.00 on equipment maintenance and 206,000.00 on Capital Purchases. 3 Regional Transportation Commission – Minutes January 20, 2022

Mr. Dahl

stated that the Board of County Commissioners has already asked for a audit of those funds also and once they get that back then we should bring it back for consideration and discussion.

Commissioner Blundo

stated that he feels the money wasn’t spent on the roads like it should have been in the past and it doesn’t help us today. Mr. Dahl stated that the CCTV of the roads should have been paid for by the utility company and those funds should be reimbursed back to the county to maintain the roads but that still isn’t going to be enough.

Commissioner Jabbour

stated that 35,000.00 utilized for the CCTV should in fact have been paid for by the utility funds and not road funds. It is a clear violation of the NRS and needs to go back to the road fund. If we find any other violations in the audit, then we will need to correct it and move forward from there.

Mr. Koenig

stated that he does not like the wording in the agreement where its states that they can opt out whenever they want to. We have never allowed any others to do this. Tim Dahl stated that this document was prepared by Public Works and approved by the DA and the Town of Round Mountain suggested the wording.

Commissioner Blundo

suggested that we have a different agreement prepared and given to the Town for approval that omits the opt out item.

Commissioner Jabbour

motioned to give staff direction to have number 3. Duration and number 5. Termination and Disposition removed from the agreement and to be reviewed by the DA’s Office. Mr. Koenig second. Commissioner Blundo asked that Public Works makes sure that the Town of Round Mountain have all contact information for members of this Board in case they need or want to reach out. FOR POSSIBLE ACTION DISCUSSION AND DELIBERATION AND DIRECTION TO STAFF FOR THE UPDATING OF THE PAVEMENT CONDITION INDEX (THIS HAS NOT BEEN DONE IN 5 YEARS)

Mr. Bolling

stated that PCI is where we observe the pavement condition and put it into a matrix so that we can see the conditions of the roads. Mr. Bolling stated that this has not been done in over 5 years. Mr. Bolling also stated that this is not a cheap process. The back-up shows that one of the quotes show that this will cost approximately $98,000.00 just to drive the roads and report it back. It will cost approximately $172,000.00 to have that information put into the database. Mr. Bolling stated that the 3rd quote is from a company called Roadbotics. They gave us a quote of $49,750.00 to input the data AFTER it has been collected, which means we would still have to pay someone to collect the data.

Mr. Bolling

stated that we are able to do this ourselves within our department of Public Works. The cost for this would be approximately $50,000.00 and take about 3-4 months to gather all the information.

Commissioner Blundo

asked Savannah what fund this would come out of. Savannah stated that she would have to look to see where it came from last time. Mr. Dahl stated that this could come out of either RTC Fund. Mr. Dahl stated that he thinks its more beneficial for us to collect the information and process the data ourselves. Mr. Bolling stated that it is going to take one of our team members away from their regular work to do this and it will take a few months. Mr. Bolling also stated that he thinks this should be done in-house also but the Techs 4 Regional Transportation Commission – Minutes January 20, 2022 that we have may have to put in overtime to get it done. Commissioner Jabbour asked what the current employee does now. Mr. Bolling stated that the only tech we have that is qualified to do this is our Tech III and right now he is also creating the agenda items for BOCC and all of our technical stuff. Mr. Bolling stated that the Tech III can also train one of the other Tech I to do this.

Mr. Koenig

stated that he agrees with Public Works and that this should be done in-house, and he would like to make that motion.

Commissioner Blundo

stated that his concern is that this gets done correctly.

Mr. LaBossier

stated that his concern is that this might be bias because people will be concerned that their road didn’t get done because the computer module said that it wasn’t bad enough to be repaired. ACTION: set time and Date for next Meeting:
