Mr. Lach

recalled a meeting with the Nevada State Engineer and the context of that meeting. Mr. Holden requested that the General Manager explore new requirements for the relinquishment of water rights in the currently adopted building development agreements. Mrs. Strickland

disclosed that she was a water rights broker but not a voting member and could therefore not pose a conflict for the board. Mr. Goedhart disclosed that he was a holder of water rights and that he would not vote on matters that might benefit himself. Mr. Lach disclosed that he owned real estate in Nye County but did not see anything that would directly effect him. Mr. Jackson disclosed that he was a well driller in Nye County and owned several water rights but that he would not be effected by the items on the agenda. Mr. Miller disclosed that also owned water rights in Nye County but that he did not see anything on the agenda that would conflict with his water rights. (00:20:25) FOR POSSIBLE ACTION -— Discussion and deliberation to direct staff to work with Nye County Administration to include the Nye County Water District in Nye County’s Code of Ordinances and Codification system. The expected yearly cost for participation in the program is $295.00 plus Nye County Administration staff time. gave a presentation on the current budget status of the Nye County water District. (01:03:26) FOR POSSIBLE ACTION -— Discussion and deliberation to approve, amend or reject a proposal from Schroeder Law Offices P.C. to provide water related legal counsel to the Nye County Water District with a do not exceed amount of $25,000. The annual contract would include up to 125 hours of legal services as general counsel. (01:10:45) PRESENTATION - Presentation by BEC Environmental, Inc. on the overview of the completed and submitted Bureau of Reclamation (BOR), Title XVI - Water Reclamation and Reuse: Water Recycling and Desalination Planning Grant Application that was submitted on February 28th, 2023. BEC Environmental delivered their presentation. (01:23:56) FOR POSSIBLE ACTION - Discussion, deliberation, and consideration to approve or deny the Official Resolution regarding the Title XVI - Water Reclamation and Reuse: Water Recycling and Desalination Planning Grant Application. (01:28:58) FOR POSSIBLE ACTION - Discussion and decision to approve or deny BEC Environmental, inc. Work Order #1, Change Order #1: Additional Funding to provide Grant Application Technical Support Services for the Nye County Water District Governing Board in the amount of $4,000, bringing the total for Work Order #1 to $12,900. (01:35:50) FOR POSSIBLE ACTION - Discussion and deliberation to approve, amend or reject a spending request to contract with Susie Rybarski Associate Research Scientist, Hydrology from Desert Research Institute to maintain and update a hydrographic model of Basin #162 for the Nye County Water District with a do not exceed amount of $10,000 for the fiscal year of 2023-2024. Nye County resident Joyce Barishman discussed her concerns about the proposed solar projects along Hwy. 160. (02:18:06) FOR DISCUSSION ONLY -— Discussion and deliberation to consider temporary limitations on new domestic well construction within the Pahrump Regional Planning District. Nye County resident John Koenig suggested that limiting new growth to 140 hookups per year would be a good idea to consider. Nye County resident Joyce Barishman expressed her concerns over being forced to put a meter on her domestic well. Norma-Jean Opatik thanked the board for the three-hour lesson into what they do. She also spoke about Order 1293a. She went on to say that she thought that item #18 should not be considered. Nye County resident Victor Fuentes recalled how the waters running through his property in Amargosa had been diverted by the Federal Government. Nye County Commissioner Debra Strickland spoke as a licensed well driller and noted that her company does not currently drill 140 well a year. She went on to state that the proposed language may infringe on the free market and that the matter was a dead issue. Nye County

Carbone stated that the valley was pumping more water even if fewer wells are being drilled. He also mentioned that some subdivisions held a massive amount of water that the state was unable to properly track all the old rights. He went on to suggest that the District hold a Workshop so all the effect parties could speak openly on the matter. (03:00:48) SUPPORTING REPORTS - Organization Member, Staff and County Liaison. (03:01:35) FOR POSSIBLE ACTION - Discussion and deliberation to set the date, time and location of the next Water District Governing Board meeting for Tuesday, May 9, 2023 at 10:00 a.m. at the Pahrump Commissioners Chambers. Nye County resident Scott Tincher explained that his well was continuing to decline and offered his support for the board and asked them to continue their efforts. Nye County resident John Koenig wanted to let people know that his water use was very low.
