7. (00:02:35) Board Comments.

Mr. Holden

discussed his continued work on new regulations that would limit utility scale solar development in Basin #162. Mr. Jackson discussed the potential for new water rights requirements that would deter utility scale solar projects. Mr. Lach stated that he felt that if an ordinance on solar restrictions came forward it should be focused on Basin #162 because much of Nye County was in favor of solar development. Mr. Lach directed the General Manager to investigate Nye County’s water rights holdings in and around the Town of Beatty. Specifically Mr. Lach directed the General Manager to look into what it would take to refile on a group of water rights that had been previously protested by a number of Federal agencies.

8. (00:09:15) Disclosure Of Ex-Parte Communications and Possible Conflict of Interest.

Mr. Goedhart

disclosed that he had private business interests and owned water rights in Pahrump and Amargosa. He went on to explain that he would recuse himself from any item which he felt presented a conflict of interest. Mr. Lach disclosed that he was a property owner in Nye County and owned water rights in the northern portion of the county but that there was nothing on the agenda that would influence his decision making..

11. (00:29:46) FOR POSSIBLE ACTION – Discussion and deliberation to offer support or

made a motion to support the proposed agreement between Nye County and Shoshone Estates Water Co-op which was seconded by Mr. Lach. The board voted unanimously to support the agreement.

15. (02:03:16) FOR POSSIBLE ACTION – Discussion and decision to approve or deny a

and Mr. Goedhart voting against the motion.

17. (03:03:01) FOR POSSIBLE ACTION – Discussion, deliberation and possible direction

Mr. Holden

made a motion to direct the General Manager to present the findings of the report once complete to the Nye County Commissioners. Mr. Jackson offered a second to the motion and the item was approved unanimously.

19. (03:16:47) FOR POSSIBLE ACTION – Discussion and deliberation to set the date,

Mr. Holden

made a motion to accept the date of November 14, 2023 for the following meeting of the Nye County Water District Governing Board. Mr. Jackson offered a second to the motion and the item was passed unanimously.

21. (03:18:37) Board Comments – (This item limited to announcements and to propose

suggested the board explore some regulatory method that would require utility scale solar projects to purchase an acre foot of water for each acre of land that the project plans to develop. Nye County Commissioner Frank Carbone explained that Nye County was working on language for an ordinance that would impose water restrictions and assured Mr. Jackson that his concept would be “entertained.”
