Mrs. Williams

mentioned comments made by members of the public concerning flood waters in Pahrump. Mrs. Williams went on to mention the water rights being used of solar farm construction in Pahrump.

Mr. Goedhart

disclosed that he had private business interests and owned water rights in Pahrump and Amargosa. He went on to explain that he would recuse himself from any item which he felt presented a conflict of interest. Mr. Lach stated that he was a property owner in Nye County and owned water rights in Northern Nye County and Nevada. He stated that there was nothing on the agenda that would preclude him from voting. Mr. Miller stated that he also owned water rights and was a property owner but that he did not see on the agenda that would preclude him from voting. Nye County Commissioner Debra Strickland stated that she was a water well driller and a broker of water rights but that she was not a member of the board and could not vote.

that water companies and utilities can charge fees for engineering services and reviews. Mrs. Stix continued with her presentation. Mr. Goedhart asked if a resident with two homes in Nye County could run for a Water District Governing Board seat if their primary resident was not in the area the individual intended to run. Mrs. Stix’s answer was no that a resident could only run in the area where they primarily lived. Mr. Lach inquired of

if a sitting Nye County Commissioner could themselves be appointed to a seat on the Nye County Water District Governing Board. Mrs. Stix offered to look that matter up and get back to him. Mrs. Williams suggested that Mrs. Stix work with the General Manager to answer Mr. Lach’s question about appointing a Nye County Commissioner to the Nye County Water District Governing Board. Mrs. Stix concluded her presentation. No action was taken.

thanked the representatives from BEC for offering to reapply for another grant later in 2024, free of charge. No action was taken.

Mr. Klenke

delivered his presentation. Under public comment Nye County Commissioner Frank Carbone stated that the valley had great snowfall the prior year due to the District’s cloudseeding program. Nye County resident Steven Pitman made the statement that 10-12 inches of snow are equivalent to one inch of liquid water and that it takes a dozen or so years for water to make its way down from the mountain before the water can be used by the community. Nye County resident Scott Tincher mentioned that he had heard about questionable nature of the basin’s recharge and available water resources. A one hour break for lunch was taken. 14. (04:00:16) PRESENTATION – Presentation by Amargosa Town Clerk Mike Cottingim on the continuing development of a Lithium Mining project near the boundary of Ash Meadows National Wildlife Refuge.

delivered his presentation. Staff was directed to notify the board of the time and location of a meeting regarding the matter scheduled for the following day in las Vegas. 10. (04:21:03) FOR POSSIBLE ACTION – FOR POSSIBLE ACTION – Discussion and deliberation to approve, amend or reject a proposal to establish a Nye County Water District rebate program for Nye County residents to replace older toilets with newer high water conservation models. Approval would establish an annual budget not to exceed $10,000 for the program. Page 4 November 14, 2023 Nye County resident Donald Hurtz asked how the district would ensure that the installation was done by a professional. Mrs. Williams retorted that the District would not be required to do so according to the parameters of the program. Mr. Lach suggested that commercial toilets be included in the program. Mr. Lach made another suggestion to include “flapper kit” replacement in the program as well. Mr. Holden stated that all toilets made following 1992 were required to be low flow models. Mr. Holden also suggested that there be no limit of one unit per household or business and that the rebates should be approved until the available funding was exhausted. Nye County resident John Koenig questioned the flow limits on the proposed toilets. Nye County resident Donald Hurtz asked about the regulations regarding updating water use appliances in residences when they are sold.

made a motion to amend and approve the $10,000 for the Toilet Rebate Program and add an additional $1,000 for Toilet Flapper Kit replacements. Mr. Jackson offered a second to the motion. The vote to accept was a unanimous 5-0-1 with Mr. Holden unavailable to vote due to technical reasons. 11. (04:48:44) FOR DISCUSSION ONLY – Discussion and deliberation with possible direction to staff to explore and draft regulations for consideration by the Nye County Water District to establish requirements that Private Water Utility Providers install backflow preventers throughout their respective systems. No action will be taken on matters discussed during this item.

Mr. Lach offered a second to the motion. The vote to accept was a unanimous 5-0-1 with Mr. Holden unavailable to vote due to technical reasons.
